Except as otherwise provided in this Charter or by ordinance, and then only to the extent allowed by law, state law applies to the procedures relating to registration of electors, filing for office by candidates, and the conduct of Village elections.
Members of the Village Council shall be elected at large.
The election of the Village Council as provided in this Charter shall be nonpartisan.
A. 
All candidates for Village Council, including the Village President, shall be nominated by petition. Each candidate's petition must be signed by at least 15 but not more than 40 qualified Village electors. No person shall sign a greater number of petitions than there are officials to be elected to the Village Council at that election. No person shall sign more than one petition for the office of the Village President.
B. 
If a person signs more petitions than there are officials to be elected to a particular office, the signature of that person shall be invalidated on all petitions for that office. Nomination petitions shall be filed with the Clerk/Treasurer not later than 5:00 p.m. on the fourth Friday prior to the date of the primary Village election. At least one week but not more than three weeks before the last day permitted for filing nomination petitions, the Clerk/Treasurer shall publish a notice of that last day and of the number of persons to be elected to the Village Council and the office of the Village President.
The Village's petition for nomination shall be substantially similar to that designed by the Secretary of State for the nomination of nonpartisan judicial officers. A supply of official petition forms shall be maintained by the Clerk/Treasurer.
A. 
The Clerk/Treasurer shall accept only nomination petitions which conform with the forms provided and maintained by the Clerk/Treasurer and which, considered together, contain the required number of valid signatures for candidates with the qualifications required for election to the Village Council as described in § C-23. When a petition is filed by a person other than the candidate, it may be accepted only when accompanied by the written consent of the candidate.
B. 
Promptly after the filing of a petition, the Clerk/Treasurer shall notify in writing any candidate whose petition is then known not to meet the requirements of this Charter; however, the Clerk/Treasurer's failure to so notify any candidate shall not prevent a final determination that the petition does not meet those requirements. Within five days after the last date for filing petitions, the Clerk/Treasurer shall make the final determination as to the validity and sufficiency of each nomination petition, and whether or not each candidate has the qualifications required for the Presidency or the Village Council.
If a primary Village election is held, its purpose shall be to reduce the number of candidates to be voted upon at the following regular Village election to twice the number of candidates as are to be elected to the Village Council. It shall also be the purpose of the primary Village election to reduce the number of candidates for the office of the Village President to two.
A. 
A Village primary election of Council members and the Village President shall be held on the first Tuesday after the first Monday in August of each odd-numbered year. Candidates in number equal to twice the number of persons to be elected to the Village Council at the upcoming election, who receive the highest number of votes at the primary election, shall be declared the nominees for election to the Village Council. If, upon the expiration of the time for filing nomination petitions, the number of candidates nominated does not exceed twice the number of candidates to be elected to the Village Council, then no primary election shall be held for the office and the Clerk/Treasurer shall publish notice of that fact.
B. 
The two candidates for the office of the Village President who receive the highest number of votes at the primary election shall be declared the nominees for election to the office of the Village President. If, upon expiration of the time for filing nomination petitions, the number of candidates nominated for the office of the Village President does not exceed two, then no primary election shall be held for the office and the Clerk/Treasurer shall publish notice of that fact.
A regular Village election shall be held on the first Tuesday after the first Monday in November in each odd-numbered year.
An Election Commission is created, consisting of the Clerk/Treasurer, the Village Attorney and a third individual appointed by resolution of Village Council. The Clerk/Treasurer shall be the Chair. The Election Commission shall have charge of all activities and duties required of it by state law relating to the conduct of Village elections. In any case where election procedure is in doubt, the Election Commission shall prescribe the procedure to be followed.
The form, printing and numbering of ballots, or the preparation of any voting machines, used in any Village election shall conform as nearly as possible to that prescribed by the general election laws of the state. However, no party designation or emblem shall appear.
The votes cast at any Village election for office or any proposition may be recounted in accordance with the general election laws of the state.
