The Borough Council of the Borough of North East, Erie County, Pennsylvania, constituting the municipal authority of the said Borough as defined in the Act of Assembly known as the "Municipality Authorities Act of 1945,"[1] approved May 2, 1945, P.L. 382, as amended, hereby signifies its intention to organize an Authority under the provisions of said Act of Assembly, as amended.

In pursuance of said intention, the Articles of Incorporation of the said Authority are hereby approved and adopted by the Council on behalf of the said Borough of North East, County of Erie and Commonwealth of Pennsylvania, in the following form:
ARTICLES OF INCORPORATION
A.
The name of the Authority shall be "North East Borough Water Authority."
B.
This Authority is formed under the Act of Assembly known as "Municipality Authorities Act of 1945," approved May 2, 1945, P.L. 382, as amended.
C.
No authority has been organized under the said Act as amended or under the Act approved June 28,1935, P.L. 462, in or for the said Borough of North East, County of Erie and Commonwealth of Pennsylvania.
D.
The names and addresses of the Council members and Burgess of said incorporating municipality are as follows: [Here followed the names, addresses of the Borough Council.]
E.
The names, addresses and terms of office of the first members of the Board of North East Water Authority are as follows: [Here followed the names, addresses, and terms of office for the first Board.] The terms of office of the first members of the Board of North East Borough Water Authority shall begin on the date of issuance of a certificate of incorporation by the Secretary of the Commonwealth of Pennsylvania.
F.
The North East Borough Water Authority is organized for the following purposes: to acquire, hold, construct, improve, maintain, operate, own and lease, either in the capacity of lessor or lessee, a water works, water supply works and water distribution systems.
This article signifying the intention to organize the said Water Authority and certified from the records of the incorporating municipality, together with proof of advertisement of notice of filing the Articles of Incorporation to the Secretary of the Commonwealth of Pennsylvania.
The North East Borough Water Authority is organized for the following purposes: to acquire, hold, construct, improve, maintain, operate, own and lease, either in the capacity of lessor or lessee, a waterworks, water supply and water distribution systems.

The President, Secretary of the Council of the Borough of North East, County of Erie and Commonwealth of Pennsylvania, be and they are hereby authorized and directed to execute said Articles of Incorporation on behalf of said Borough, affix thereto the seal of said Borough, cause a notice of the filing of said Articles of Incorporation to be published once in the Erie County Legal Journal, and once in the "Breeze," a publication of the Breeze Publishing Company, as required by this article, together with the proof of advertisement of notice of said Articles of Incorporation with the Secretary of the Commonwealth of Pennsylvania, accompanied by the required filing fee as provided by the Municipality Authorities Act of 1945,[1] as amended. President of said Council be and hereby is authorized, empowered and directed to acknowledge said Articles of Incorporation and the execution thereof to be the act and deed of the said Borough.

An order drawn on the Treasurer of said Borough of North East to pay the required fee for filing said Articles of Incorporation, and the amount necessary to pay said fee is hereby appropriated from the general treasury of said Borough of North East, County of Erie and Commonwealth of Pennsylvania.

The term of existence is being increased for a period of 50 years from the date of approval of the within amendment by the Secretary of the Commonwealth of Pennsylvania.

B.
This Authority is formed under the Act of Assembly, known as "Municipality Authorities Act of 1945" approved May 2,1945, P.L. 382, as amended.
C.
An authority has been organized under the said Act approved May 2, 1945, P.L. 382, and known and cited as the "Municipality Authorities Act of 1945," and said authority is in existence, the name of which is "North East Borough Water Authority," the same being approved by the Department of State on May 18, 1955, No. 3-1-55, 15403.
D.
The name of the incorporating municipality is the Borough of North East, County of Erie and Commonwealth of Pennsylvania. The names and addresses of the Council members and Burgess of said incorporating municipality are as follows: [Here followed the names and address of the Borough Council.]
E.
The names, addresses and terms of office of the first members of the Board of the North East Borough Sewer Authority are as follows: [Here followed the names, addresses and terms of office of the first Board.] The terms of office of the first members of the Board of North East Borough Sewer Authority shall begin on the date of issuance of a certificate of incorporation by the Secretary of the Commonwealth of Pennsylvania.

The North East Borough Sewer Authority is organized for the following purposes: to acquire, hold, construct, improve, maintain, operate, own and lease, either in the capacity of lessor or lessee, sewers, sewer systems or parts thereof, sewage treatment works, including works for treating and disposing of industrial waste.
This article signifying the intention to organize the said Sewer Authority and certified from the records of the incorporating municipality together with proof of advertisement of notice of filing the Articles of Incorporation to the Secretary of the Commonwealth of Pennsylvania.
The North East Borough Sewer Authority is organized for the following purposes: to acquire, hold, construct, improve, maintain, operate, own and lease, either in the capacity of lessor or lessee, sewers, sewer systems or parts thereof, sewage treatment works, including for treating and disposing of industrial wastes.
