This article shall apply to grading, excavation and fill on an individual one- or two-family residential lot that is not classified as either a land development or a subdivision under Chapter 184 in the Code of the Borough of Franklin Park, Subdivision and Land Development, as amended.
A. 
A grading permit shall be obtained from the Building Inspector/Zoning Officer under this Article III if one or more of the following conditions are proposed for an individual one- or two-dwelling residential site:
(1) 
Disturbance of a land area 5,000 square feet or larger but excluding general lawn maintenance.
(2) 
Cut or fill excavations more than five feet in height.
(3) 
Cut or fill of slopes three to one or greater in slope.
(4) 
Erection of retaining walls greater than four feet in height.
(5) 
Expansion of previous grading work with any of the above existing conditions.
B. 
A grading permit shall not be required under this article for any of the following:
(1) 
Normal agricultural operations, including but not limited to planting, tilling and seeding.
(2) 
When the grading does not exceed new construction authorized by a building permit issued by the Building Inspector/Zoning Officer. Grading under the authorization of a building permit shall follow standards and regulations of Article II.
A. 
Plans and drawings, including topographical, profile and cross-section drawings, shall be submitted showing any retaining walls, keys, drainage and any other details of the cut and/or fill site.
B. 
Plans and drawings shall be in accordance with acceptable engineering practices and standards and shall be sealed by a Pennsylvania registered design professional.
C. 
Plans and drawings showing slopes greater than 2:1 shall have documentation sealed by a registered soils engineer specifying adequate soil stability of the site.
D. 
Erosion and sedimentation control plan approval from the Allegheny County Conservation District shall be submitted.
E. 
The site shall comply with all applicable requirements contained in Chapter 178 of the Code of the Borough of Franklin Park, Stormwater Management.
F. 
More than one lot or property may be included in the permit with the authorization of all property owners involved.
G. 
All plans and drawings shall be reviewed and approved by the Borough Engineer prior to the issuance of a permit by the Building Inspector/Zoning Officer.
A. 
All graded surfaces that are or have been dormant for 15 days or more shall be matted, seeded or sodded, and watered, tended and maintained until growth is well established.
B. 
The site shall be maintained in accordance with the Allegheny County Conservation District erosion and sedimentation control approval.
C. 
Any dust created from work at the site shall be controlled.
D. 
The finish grade of all grading site work shall be blended with the grade of the abutting property lines.
E. 
All grading, excavations and fill conducted under this article shall be in accordance with accepted engineering practices and standards.
F. 
Only clean fill shall be used for grading. Rubbish, garbage, trees, brush and any other deleterious materials shall be prohibited for use as fill.
A. 
Grading permits under this Article III shall expire 180 days after issuance.
B. 
If the permit holder presents satisfactory evidence that unusual difficulties have prevented work being completed within the specified time limit, the Building Inspector/Zoning Officer may grant a reasonable extension of time, provided that the application for the extension of time is made before the date of expiration of the permit.
