The following words, when used in this Chapter, shall have the meanings set out herein:
ADOPTION
To assume ownership of said animal. To cause any animal to be innoculated against rabies and registered and licensed as required by the City of Pevely and to cause sterilization of the animal to be performed by a licensed veterinarian within thirty (30) days of the adoption date as signed by the agreement.
AT LARGE
A dog, cat or other animal shall be deemed to be at large when it is off the property of its owner and not under the restraint of a competent person. A chicken shall be deemed at large when it is outside of the chicken coop.

CAT
All domesticated species or varieties of the genus felis, male or female six (6) months of age or older.
CHICKEN
All domesticated species or variety of the genus gallus, male or female, at any age.

COMPETENT PERSON
One who can control the animal and to whom the animal gives obedience.
DOG
All domesticated members of canis familaris, male or female, six (6) months of age or older.
EUTHANIZE
To destroy a dog, cat, chicken, or other animal in a humane manner.

EXPOSED TO RABIES
When bitten by, or fought with, or has come in close contact with a dog or other animal shown to be infected with the rabies virus as determined by standard laboratory testing.
HOUSEHOLD
Those members of a family, including foster children, servants and attendants, living in the same dwelling unit.
IMPOUND
Apprehending, catching, trapping, netting or tranquilizing by gun dart and confining.
ISOLATED, CONFINED, CONFINEMENT
The secure penning of a dog, cat or other animal so as to effectively separate the animal from adult, child or other animal.
KENNEL

1. 
Any person, persons, group or corporation engaged in breeding, buying, selling, sheltering or boarding of dogs or cats, whether for pleasure or for profit or breeding or exhibiting shall be deemed to be the operator of a kennel.
2. 
Any place or tract of land, whether indoors or outdoors, whether enclosed or not, used for the purpose of selling, breeding, boarding, or training dogs or cats, or both, or the keeping of four (4) or more dogs over four (4) months of age, or the keeping of six (6) or more cats over four (4) months of age. The maximum number of pet animals that may be kept in a residential dwelling is a combination of up to five (5) animals over four (4) months of age, but no more than three (3) dogs.
KITTEN
All domesticated species or varieties of the genus felis, male or female, under six (6) months of age.
OTHER ANIMAL
Any warm-blooded animals including, but not limited to, wolves, skunks, fox or opossums, but not including chickens.

OWNER
Includes any person who or firm or corporation which owns, harbors, shelters, keeps, controls, manages, possesses or has part interest in any dog, cat or kennel; the occupant of any premises on which a dog or cat remains for a period of ten (10) days or to which it customarily returns daily for a period of ten (10) days is presumed to be harboring, sheltering or keeping the aforementioned dog or cat within this definition. If a minor owns a dog, puppy, cat or kitten or other animal subject to the provisions of this Chapter, the head of the household of which said minor is a member shall be deemed to be the owner of such dog, puppy, cat or kitten or other animal for the purpose of this Chapter and under this Chapter shall be responsible as the owner, whether or not such household head is himself/herself minor. A person or firm or corporation receiving a dog or cat or other animal for temporary care while ill or for safe keeping shall not be deemed to be the owner of said animal.
POUND
Any premises designated by the City of Pevely for the purpose of impounding and caring for all dogs, cats, chickens, or other animals found to be or suspected of being in violation of this Chapter.

PUP or PUPPY
All domesticated members of canis familaris, male or female, under six (6) months of age.
REGISTRAR
The City Clerk or authorized representative.
REGISTRATION CERTIFICATE
A certificate issued at the time the fee is paid bearing a registration number, the name, color, breed and sex of the animal, the name of the veterinarian administering the vaccination for rabies, the date of said vaccination, the name and address of the owner and the date of registration.
REGISTRATION, REGISTERED
The providing of the necessary information to the registrar for completion of the registration certificate, in triplicate, and payment of fee for same. The word registration in this Chapter refers to the procedure as it applies to one (1) specific dog, cat or other animal.
RESTRAINT
An animal is under restraint within the meaning of this Chapter if it is controlled by a leash not more than six (6) feet long or is at "heel" beside a competent person or is carrying out instructions of a competent person as a bird dog or hound in hunt or a Police dog at work or on or within a vehicle being driven or parked on a street or road or on the property of his/her owner.
RUNNING AT LARGE
Allowing a dog or cat to be off the private premises of the owner or keeper, or his/her agent or servant, and not on a leash or confined to the arms, motor vehicle, trailer or other conveyance of the owner or keeper, his/her agent or servant. Allowing a chicken to be outside of the chicken coop.

SERIOUS PHYSICAL INJURY
Physical injury that creates a substantial risk of death or that causes serious disfigurement or protracted loss or impairment of the function of any part of the body.
STERILIZATION
Sterilization is required pursuant to Sections (7) through (9) of Senate Bill 636 of the 86th General Assembly of Missouri.
TRESPASSER
A person upon the premises of the owner or keeper of the dog in question without license or privilege to be upon said premises.
UNRESTRAINED DOG
Any dog running at large or a dog on the premises of its owner or keeper but not confined to said premises by a leash, fence, structure or other means that would prevent the dog from leaving such premises.
VICIOUS DOG
Any of the following dogs:
1. 
Any dog, whether or not running at large and whether or not unrestrained, that without provocation has bitten any person not a trespasser causing serious physical injury to that person.
2. 
Any unrestrained dog, whether or not running at large, that without provocation has attempted to bite any person not a trespasser which would cause serious physical injury to that person.
3. 
Any unrestrained dog, whether or not running at large, that without provocation has placed any person not a trespasser in apprehension of immediate serious physical injury.
4. 
Any dog that has killed another dog, cat or other domestic animal without provocation.
