A retail fireworks license must be obtained by any person engaging in the retail sale of fireworks within the City of Ironton. The fee for such license shall be one hundred dollars ($100.00) per year. Out of the one-hundred-dollar ($100.00) fee, the sum of ten dollars ($10.00) shall be consigned to the Fire Chief for safety inspection as provided herein.

The Fire Chief or his/her authorized agent shall inspect the proposed premises, location, stand, etc., with particular attention to the possibility of the igniting of adjacent buildings or properties in the event of fire. The inspecting officer shall make his/her written or oral report to the Board of Aldermen at the session thereof which shall consider the application for license. For any subsequent investigation for alleged violations, the Fire Chief shall receive the sum of ten dollars ($10.00) which shall be paid from the initial one-hundred-dollar ($100.00) license fee.

The following shall be exempted from the necessity to obtain a retail fireworks license: Any retail store which shall carry a fireworks line as less than fifty percent (50%) of its stock and which shall remain open throughout the year and not seasonally, and any persons operating such retail store.

No fireworks shall be offered for retail sale within the City limits at any time other than during fireworks season. Fireworks season shall be the period beginning on the 20th day of June and continuing through the 10th day of July of the same year and the period beginning on the 20th day of December and continuing through the second day of January of the next year, which shall be the only periods of time that seasonal retailers may be permitted to sell consumer fireworks.

No person, persons, firm, association, partnership or other corporation shall, willfully or promiscuously, fire or shoot off or set off, use, burn, explode or fire off any firecrackers, fireworks, torpedoes, bombs, rockets, pinwheels, fire balloons, Roman candles, toy cannons, toy pistols, or any other fireworks of any kind whatsoever, within the limits of the City of Ironton, except such shooting off fireworks shall be allowed until 11:00 P.M. on July 3, and July 4; providing, however, the provisions of this Section shall not prohibit or prevent the Board of Aldermen from issuing a permit to any competent person or persons authorizing them to fire, shoot off a display of fireworks in the public parks or other public places of this City for the benefit of the public. In all cases, any person or persons who shall, in this City, discharge or set off any rockets or other pyrotechnic exhibition, without a written permit from the Mayor specifying the time and place when and where the same may be done, shall be deemed guilty of an ordinance violation.

Any person or corporation in violation of the provisions of this Section may be punished in accordance with Section 100.220. Any person making an illegal fireworks sale after having earlier that day been charged with such offense shall be deemed to have committed a second violation.
