Before any person, firm, organization or corporation shall make any excavation in the streets, sidewalks or alleys of the City, such person, firm, organization or corporation shall apply for and obtain a permit to make such excavation in any street, sidewalk or alley of the City under the regulations and on payment of such fees and deposits as hereinafter provided.

The City Clerk is hereby authorized and directed to have printed at the expense of the City such permit forms and appropriate forms for such permits in such numbers as may be necessary.

Before any excavation permit as provided in and required by Section 510.030 of the City's Municipal Code is issued, the applicant shall pay to the City the amount of fifty dollars ($50.00) as a permit and inspection fee to cover the City's reasonable costs in issuing said permit and in conducting the necessary inspection(s). In addition, the applicant if a public utility shall provide to the City a performance bond in a form acceptable to the City or if the applicant is not a public utility, the applicant shall provide to the City a cash security deposit. Said bond or security deposit, as the case may be, shall be in an amount equal to fifty dollars ($50.00) per square foot of excavation covered by the permit to indemnify the City against any loss, claim or expense the City may incur by reason of applicant's failure to fully and timely refill, replace, repair and maintain from the date of completion any street, sidewalk, alley or other area excavated and all surrounding work areas pursuant to said permit.

Said bond and security deposit as provided in above Section 510.060 shall be released and refunded, as appropriate, upon issuance by City's Street Commissioner of a certificate of inspection and completion certifying that all work pursuant to said permit and restoration of the area excavated and of the surrounding work area have been properly performed and restored to their previous condition. The failure of the applicant to perform properly and to restore the area excavated and its surrounding work area to their previous condition shall result in a forfeiture of the bond or security deposit and the funds so forfeited shall be utilized by the City to perform such work and to make such restoration with the balance of said funds, if any, returned to the applicant.

It shall be the duty of the City Clerk to collect all fees and deposits from all applicants hereunder and to account therefor monthly to the Treasurer of the City and to pay into the hands of the Treasurer all such sums coming into his/her hands.
