A. 
The City of Hollister shall be classified and divided into Districts designated as follows:
1. 
Agricultural District.
"A-1" Agricultural District
2. 
Residential Districts.
"R-1" One-Family Dwelling District
"R-2" One- and Two-Family Dwelling District
"R-3" Any Residential Use
"R-4" Multiple-Family Dwelling District
"R-5" Manufactured Home District
3. 
Commercial Districts.
"C-1" Commercial District
"C-2" Commercial District
"C-3" Commercial District
"C-R" Commercial Retail District
4. 
Industrial District.
"I-1" General Industrial District
5. 
Historic District.
"H-1" Historic Building District
B. 
Zoning District Map. The Zoning District Map, which is on file in the office of the City Clerk, shows the boundaries of the areas covered by the Districts listed in Subsection (A) of this Section.
C. 
Interpretations.
1. 
This interpretation and application of the provisions of this Code shall be by the Code Official. An appeal of an interpretation by the Code Official shall be submitted to the Board of Adjustment, who, unless otherwise provided, is authorized to interpret the Code, and such interpretation shall be considered final.
2. 
Uses are permitted within the various zones as described in this Code and as otherwise provided herein.
3. 
It is recognized that all possible uses and variations of uses which might arise cannot reasonably be listed or categorized. Mixed uses/sites or any use not specifically mentioned or about which there is any question shall be administratively classified by comparison with other uses identified in the zones described in this Code. If the proposed use resembles identified uses in terms of intensity and character, and is consistent with the purpose of this Code and the individual zones classification, it shall be considered as a permitted/non-permitted use within a general zone classification, subject to the regulations for the use it most nearly resembles. If a use does not resemble other identified allowable uses within a zone, it may be permitted as determined by the Planning Commission and Board of Aldermen pursuant to Section 400.180.
D. 
Liability.
1. 
The Code Official, or designee, charged with the enforcement of this Code, acting in good faith and without malice in the discharge of the duties described in this Code, shall not be personally liable for any damage that may accrue to persons or property as a result of an act or by reason of an act or omission in the discharge of such duties. A suit brought against the Code Official or employee because of such act or omission performed by the Code Official or employee in the enforcement of any provision of such Codes or other pertinent laws or ordinances implemented through the enforcement of this Code or enforced by the enforcement agency shall be defended by the jurisdiction until final termination of such proceedings, and any judgment resulting therefrom shall be assumed by the jurisdiction.
2. 
This Code shall not be construed to relieve from or lessen the responsibility of any person owning, operating or controlling any building or parcel of land for any damages to persons or property caused by defects, nor shall the enforcement agency or its jurisdiction be held as assuming any such liability by reason of the reviews or permits issued under this Code.
E. 
Cooperation Of Other Officials And Officers. The Code Official may request, and shall receive so far as is required in the discharge of the duties described in this Code, the assistance and cooperation of other officials of the jurisdiction.

A. 
Where uncertainty exists with respect to the boundaries of any of the aforesaid Districts as shown on the Zoning District Map, the following rules shall apply:
1. 
Where district boundaries are indicated as approximately following the center lines of streets or highways, street lines, or highway right-of-way lines, such center lines, street lines, or highway right-of-way lines shall be construed to be such boundaries.
2. 
Where district boundaries are so indicated that they approximately follow the lot lines, such lot lines shall be construed to be said boundaries.
3. 
Where district boundaries are so indicated that they are approximately parallel to the center lines or street lines of streets, or the center lines or right-of-way lines of highways, such district boundaries should be construed as being parallel to and at such distance from as indicated on the Zoning District Map. If no distance is given, such dimension shall be determined by the use of the scale shown on the Zoning District Map.
4. 
Where the boundary of a district follows a railroad line, such boundary shall be deemed to be located in the middle of the main tracks of said railroad line.
5. 
Where the boundary of a district follows a stream, lake or other body of water, the boundary shall be the limit of the jurisdiction of the City of Hollister, unless otherwise indicated.

Whenever any street, alley, public way, railroad right-of-way, waterway or other similar area is vacated by proper authority, the districts adjoining each side of such street, alley, public way, railroad right-of-way, or similar area should be extended automatically to the center of such vacation and all area included in the vacation should then and thenceforth be subject to all appropriate regulations of the extended districts. In the event of a partial vacation, the adjoining district, or district nearest the portion vacated, should be extended automatically to include all the vacated area.

The application fee for vacating shall be fifty dollars ($50.00).
