Township of Tobyhanna, PA Article III Intermunicipal Sewage Collection and Disposal Services

§ 12-11 Authorization of entry into intergovernmental cooperation agreement.

The proper officers of the Township are hereby authorized and directed to execute and deliver on behalf of the Township the Intermunicipal Sewage Collection and Disposal Services Agreement (the "agreement"), in substantially the form attached hereto as Exhibit "A,"[1] with respect to the authorization, powers, requirements, conditions and implementation of a Tobyhanna Township Sewer Collection System which shall collect sewerage from a specified area within Tobyhanna Township and transmit the same to and through the Pocono Township Sewer Collection System, which shall in turn be transmitted to and treated by the Brodhead Creek Regional Authority.

§ 12-12 Tobyhanna Sewer Service Area.

The agreement shall be entered into by and between the Township and Pocono Township in order to implement the Tobyhanna Township Sewer Collection System that will transmit sewage from a specified area within Tobyhanna Township and transmit the same to the Pocono Township Sewer Collection System.

§ 12-13 Authorization of further action.

The proper officers of the Township are hereby authorized and directed to take all such actions, execute, deliver, file and/or record all such documents, publish all notices and otherwise comply with the provisions of this article and the Act insofar as the transaction contemplated by this article, in the name and on behalf of the Township.
