The proper officers of the Township are hereby authorized and
directed to execute and deliver on behalf of the Township the Intermunicipal
Sewage Service Area Agreement (the "agreement"), in substantially
the form attached hereto as Exhibit "A,"[1] with respect to the authorization, powers, requirements,
conditions and implementation of a Tobyhanna Township Sewer Collection
System which shall collect sewage from a specified area within Tobyhanna
Township known as the "Tobyhanna Township Sewer District No. 1" and
transmit the same to and through the Pocono Township Sewer Collection
System, which shall in turn be transmitted to and treated by the Brodhead
Creek Regional Authority.

The agreement shall be entered into by and between the Township
and the Brodhead Creek Regional Authority and Pocono Township in order
to authorize, regulate, govern and implement the Tobyhanna Township
Sewer Collection System that will transmit sewage from a specified
area within Tobyhanna Township, as described in the agreement, and
transmit the same to and through the Pocono Township Sewer Collection
System and thereafter to the Brodhead Creek Regional Authority Sewage
Treatment Plant for treatment.
The proper officers of the Township are hereby authorized and
directed to take all such actions, execute, deliver, file and/or record
all such documents, publish all notices and otherwise comply with
the provisions of this article and the Act insofar as the transaction
contemplated by this article, in the name and on behalf of the Township.
