A. 
No person, partnership, firm, association or corporation shall construct, set up, enlarge, alter, remove or demolish any building or structure, including but not limited to trailers, mobile homes, swimming pools, garages, and sheds, within the Township of Tobyhanna without first having obtained the appropriate permit therefor. It shall be unlawful to construct, add to, alter, remove or demolish, or to commence the construction, addition, alteration, removal or demolition of, any such building or structure, other than ordinary repairs as defined herein, without first filing with the Building Code Official an application in writing and obtaining a formal permit.
B. 
Permit required. A permit shall be obtained before beginning construction, alteration or repairs, other than ordinary repairs, using application forms furnished by the Building Code Official. "Ordinary repairs" are nonstructural repairs and do not include additions to, alteration of, or replacement or relocation of water supply, sewer, drainage, drain leader, gas, soil, waste, vent or similar piping, electrical wiring, or mechanical or other work for which a permit is required by the Building Code Official. A permit is required for all residential alterations and renovations, including, but not limited to, reroofing, decks, electrical service replacements, furnaces and hot water boilers. A construction permit is required for garages, carports, greenhouses and sheds accessory to a single-family dwelling which are greater than 200 square feet.
Pursuant to the authority contained in the enabling legislation and by virtue of the authority contained in this chapter, the fees relating to the permits referenced in this chapter may be set, amended, changed or altered by resolution of the Board of Supervisors without the necessity of reenacting and/or amending this chapter.
A. 
Plans required. All applications shall be accompanied by two sets of plans drawn to scale and shall be of sufficient clarity to indicate the nature and extent of the work proposed and shall show in detail that it will conform to the provisions of this chapter and all relevant laws, ordinances, rules and regulations.
B. 
Plans of job required. A copy of approved plans shall be kept on the site of the building or work at the time of all inspections until a certificate of occupancy has been issued.
C. 
Notwithstanding any other provision of this chapter, any plan required to be submitted by this chapter shall also include a copy on computer-readable media in either AutoCAD R14, AutoCAD 2000, TIFF image format or Esri ArcInfo/ArcView, with all required media containing Pennsylvania State Plane N, NAD83 coordinates, or such other electronic, digital or computer-readable media or format as designated from time to time by resolution duly enacted by the Board of Supervisors.
D. 
Reinspection fees. There will be a fee charged for reinspection performed each time the Building Code Official or other authorized inspector revisits the job site for each and every required inspection. The amount of such fee shall be set from time to time by the Board of Supervisors by resolution. Reinspection will not be performed until all outstanding fees are paid.
E. 
Certificates of occupancy will not be issued until all Township fees have been paid. Occupancy of a building prior to the issuance of a certificate of occupancy is prohibited unless specifically approved by the Township in writing.
No dwelling or commercial building shall be started, and no permit for the same shall be issued, until the applicant furnishes evidence of approval of a sewage disposal system under the laws of the Commonwealth of Pennsylvania and the Township of Tobyhanna.
This chapter shall be enforced by action brought before a District Justice in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure. Any person who violates or permits the violation of this chapter shall, upon conviction in a summary proceeding, be punishable by a fine of not more than $1,000, by imprisonment for a term not exceeding 90 days, or both. Each day or portion thereof that such violation continues, or is permitted to continue, shall constitute a separate offense. Each section of this chapter that is violated shall also constitute a separate offense. This shall not limit and/or restrict any other possible causes of action, claims, resolutions and/or recourse the Township may have against a person that has violated this chapter.
