to the recommendation of the Monroe County Planning Commission, the
Board of Supervisors of Tobyhanna Township hereby assigns, establishes,
adopts and/or confirms the following Township road names within the
Township of Tobyhanna in accordance with the Monroe County 911 Addressing
Project:

The locations of the roads listed in § 128-24A above are shown on a plan titled "Tobyhanna Township Road Names" and prepared by the Monroe County Planning Commission in accordance with the Monroe County 911 Addressing Project and dated March 2011 ("Tobyhanna Township Road Names Plan"), and said plan can be found at the Township of Tobyhanna and the Monroe County Planning Commission offices. The Tobyhanna Township Road Names Plan is specifically incorporated herein by reference and made a part hereof.

The Township road names listed in § 128-24A above are hereby assigned, established, adopted and/or confirmed as the official names for the Township roads located within Tobyhanna Township, and the general locations of such roads listed in § 128-24A above are shown on the aforementioned Tobyhanna Township Road Names Plan. Any road not listed in § 128-24A above but identified on the Tobyhanna Township Road Names Plan is not a Township road. The roads identified on the Tobyhanna Township Road Names Plan and not listed in § 128-24A above are private roads within the Township of Tobyhanna. Any road not included on said Tobyhanna Township Road Names Plan and/or § 128-24A above shall not be deemed to have been vacated by the Board of Supervisors, nor shall the road or road lines indicated on the Tobyhanna Township Road Names Plan be deemed to constitute the opening or establishment of any road, nor the taking or the acceptance of any land for street purposes, nor shall it obligate the Township to improve or maintain any such road. The Tobyhanna Township Road Names Plan shall be in no way conclusive as to the exact and precise location of any road or landmark hereon, and said Tobyhanna Township Road Names Plan only shows the general locations of such roads. The Tobyhanna Township Road Names Plan is only intended to illustrate the names given and/or assigned to such roads within Tobyhanna Township.
The proper authorities of the Township are hereby directed to
erect official signs establishing the names of the aforementioned
Township roads, and to do so in conformity with the provisions of
the Tobyhanna Township Code of Ordinances and the Pennsylvania Vehicle
Code.[1]

Any road not listed in § 128-24A above but identified on the Tobyhanna Township Road Names Plan is not a Township road. The roads identified on the Tobyhanna Township Road Names Plan and not listed in § 128-24A above are private roads within the Township of Tobyhanna pursuant to the Monroe County 911 Addressing Project. Any such road included on said Tobyhanna Township Road Names Plan shall not be deemed to constitute the opening or establishment of any road, nor the taking or the acceptance of any land for street purposes, nor shall it obligate the Township to improve or maintain any such road.
As used in this article, the following terms shall have the
meanings indicated:
Includes any public street, road, roadway, lane, court, cul-de-sac,
public way, accessway and/or public square, as well as certain specified
private roadways within Tobyhanna Township.
The Board of Supervisors shall have the authority to assign
names to all public and certain private streets, driveways, roads,
roadways, and access roads in the Township of Tobyhanna and to change
such names if deemed necessary to achieve the purpose of this article
and to ensure the public health, safety and general welfare. In the
case of new subdivisions and land developments, the road names shall
be included on the plans required by the Tobyhanna Township Subdivision
and Land Development Ordinance[1] and shall be subject to review and approval by the Tobyhanna
Township Board of Supervisors.
No road name sign shall be posted on any public or private road
unless the Township has approved such name in order to avoid duplication
of road names.
A.
Upon written petition of at least 2/3 of the persons owning frontage
and/or surface rights to property abutting an existing road, and/or
upon written petition of the fee simple owner of an existing road
in its entirety, the Board of Supervisors may consider approving a
requested name change of an existing road, provided that:
(1)
The proposed new name shall not duplicate the name of any other existing
road.
(2)
The proposed new name shall not conflict with the intent of the Monroe
County 911 Addressing Project.
(3)
In those instances where a road is located in more than one municipality,
the petitioners shall obtain the approval of all such municipalities
within which the road is located.
(4)
The petitioners shall agree to and execute an applicable professional
services contract with the Township to cover any and all costs associated
with the requested road name change.
(5)
The petitioners shall obtain any and all additional approvals needed
to complete the name change, including but not limited to the approval
of the applicable United States Postal Service Postmaster and the
County of Monroe.
(6)
The petitioners shall provide the Township with sufficient evidence
of property ownership along and/or throughout the subject road.
(7)
The petitioners shall provide evidence that the fee simple owner
of the subject private road agrees with the requested name change.
