Editor's Note: The authority of the Township to adopt ordinances
and resolutions concerning traffic and parking is contained in N.J.S.A.
39:4-197. Various statutory provisions throughout Title 39 control
the manner in which municipalities may regulate parking and traffic.
N.J.S.A. 39:4-8 sets forth the requirements for approval of such ordinances.
As used in this article, words and phrases concerning traffic
shall have the meanings ascribed to them in N.J.S.A. 39-1.
Whenever certain hours are named in this article, they shall
mean either Eastern Standard Time or Eastern Daylight Saving Time,
as may be in current use in the Township.
A.
Regulations not exclusive. The provisions of this article imposing
a time limit on parking shall not relieve any person of the duty to
observe other more restrictive provisions prohibiting or limiting
the stopping, standing or parking of vehicles, as set forth in N.J.S.A.
39:4-138, any other New Jersey statute or as hereinafter provided.
B.
Parking prohibited during state of emergency.
(1)
Upon the declaration of an emergency, there shall be no parking upon
streets or sections of streets where temporary EMERGENCY NO PARKING
signs are displayed. The Chief of Police, or in his/her absence the
ranking officer, shall be authorized to declare an emergency and to
direct the posting of EMERGENCY NO PARKING signs where weather conditions,
accidents, fires, public celebrations, etc., dictate or require the
avoidance of hazards or other conditions which interfere with the
free flow of traffic. Notification that EMERGENCY NO PARKING signs
are being or shall be posted shall be given to the operator or owner
of any vehicle which has been parked prior to the posting of the signs.
(2)
Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any peace officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of the removal and
storage which may result from such removal, before regaining possession
of the vehicle.
(3)
The effectiveness of this subsection is contingent upon signs being
erected as required by law.
D.
Parking prohibited during certain hours on certain streets. No person
shall park a vehicle between the hours specified on any day, except
Sundays and public holidays, upon any of the streets or parts of streets
described in Schedule II, attached to and made a part of this article.[2]
E.
Parking time limited on certain streets. No person shall park a vehicle
for longer than the time limit designated at any time between the
hours listed on any day, except Sundays and public holidays, upon
any of the streets or parts of streets described in Schedule III,
attached to and made a part of this article.[3]
F.
Stopping or standing prohibited during certain hours on certain streets.
No person shall stop or stand a vehicle between the hours specified
on any day, except Sundays and public holidays, upon any of the streets
or parts of streets described in Schedule IV, attached to and made
a part of this article.[4]
G.
Snow removal.
(1)
Whenever snow has fallen and the accumulation is such that it covers
the street or highway, no vehicle shall be parked on the streets or
highways or portions thereof indicated in Schedule V, attached hereto
and made a part of this article.[5]
(2)
This parking prohibition shall remain in effect after the snow has
ceased until the streets have been plowed sufficiently so that parking
will not interfere with the normal flow of traffic.
I.
Handicapped Parking.
(1)
Pursuant to N.J.S.A. 39:4-197, which confers upon the Township the
right to establish handicapped parking spaces in order to preserve
and safeguard the public health, safety, morals and welfare, certain
areas are hereby established within the Township which shall be designated
as handicapped parking spaces.
(2)
Such areas shall be used by persons who have been issued special
identification cards by the Division of Motor Vehicles. No other person
shall be permitted to park in these spaces described in Schedule VII,
attached to and made a part of this article.[7] Such spaces shall be marked by signs indicating that they
are handicapped parking spaces in conformance with the Manual on Uniform
Traffic Control Devices for Streets and Highways, adopted by the New
Jersey Department of Transportation.

Temporary parking restrictions.

(1)
When, in the determination of the Construction Official, the Township
Engineer or the Chief of Police, a hazard exists, particularly, the
obstruction of a sidewalk or pedestrian walkway in front of or adjacent
to a residential or commercial property where the obstruction would
require pedestrians to use the roadway in lieu of the sidewalk or
pedestrian walkway to traverse from one side of the property to another,
the Township Council may adopt a resolution creating a limited and
temporary "no parking" area in front of and/or adjacent to the property
which restriction shall be posted by the Police Department. The limits
of the no parking area, including, but not limited to, its physical
length and calendar duration, shall be fixed on a case-by-case basis
considering the type of construction and safety of the pedestrians.
The temporary zone shall be established immediately upon the issuance
of a permit, the commencement of construction or upon a safety determination
by the Township Engineer or Chief of Police. The resolution adopted
by the Township Council shall be made retroactive to the date of the
establishment of the zone.
(2)
In creating the temporary parking zone, the Construction Official,
in coordination with the Township Engineer, where necessary, may require
the establishment of a physical barrier to be established by and at
the expense of the property owner or permit holder which shall consider
the speed limit of the roadway, the traffic volume, lighting, accessibility
and other safety considerations. The Township officials shall determine
the materials to be utilized, including, but not limited to, cones,
caution tape and/or physical barriers.
(3)
If physically possible based on the barrier, the permit holder may
allow one vehicle to enter the no parking area for a maximum fifteen-minute
period in the morning and evening for the loading and unloading of
equipment or supplies. Said parking is not permitted before or after
daylight hours and efforts shall be taken to ensure that pedestrians
are given priority and safe access while the permit holder is loading
or unloading equipment or supplies.
(4)
In addition to any fines or penalties which may be levied against
a violator by a court of competent jurisdiction, the Township Police
Department is authorized to immediately cause any vehicle in violation
of this subsection to be towed and stored as permitted by law. Within
the first 24 hours of establishment of the parking zone, the vehicle
owner shall be given notice of the parking restrictions and a reasonable
but limited opportunity to remove the vehicle before it is towed.
A.
Speed zones. Pursuant to the provisions of N.J.S.A. 39:4-98, the
roadways or parts of streets described in Schedule VIII, attached
to and made a part of this article,[1] are hereby designated as speed zones with speed limits
as specified. Regulatory and warning signs shall be erected and maintained
to effect the designated speed limits, as authorized by the Department
of Transportation.
B.
Through streets designated. Pursuant to the provisions of N.J.S.A.
39:4-140, the streets or parts of streets described in Schedule IX,
attached to and made a part of this article[2] are hereby designated as through streets. Stop signs shall
be installed on the near right side of each street intersecting the
through street except where yield signs are provided for in the designations.
C.
Stop intersections designated. Pursuant to the provisions of N.J.S.A.
39:4-140, the intersections described in Schedule X, attached to and
made a part of this article,[3] are hereby designated as stop intersections. Stop signs
shall be installed as provided therein.
D.
Four-way stop intersections. Pursuant to the provisions of N.J.S.A.
39:4-140, the intersections described in Schedule XI, attached to
and made a part of this article,[4] are hereby designated as four-way stop intersections.
Stop signs and supplemental away panels shall be installed as provided
herein.
E.
Yield intersections designated. Pursuant to the provisions of N.J.S.A.
39:4-140, the intersections described in Schedule XII, attached to
and made a part of this article,[5] are hereby designated as yield intersections. Yield right
of way signs shall be installed as provided therein.
H.
No passing
zones designated. The locations described in Schedule XXI, § 201-
31, attached to and made part of this chapter, are designated as "no-passing
zones."

The streets or parts of streets described in Schedule XV, attached
to and made a part of this article,[1] are hereby designated as one-way streets in the direction
indicated.
Except for the pick up and delivery of materials, trucks over
four tons gross weight are hereby excluded from the streets or parts
of streets described in Schedules XVI, XVII and XVIII, attached to
and made a part of this article.[1] These restrictions shall not apply to the operation of
farming or agricultural equipment on such streets.
The locations described in Schedule XIX, attached to and made
a part of this article,[1] are hereby designated as taxi stands.
Unless another penalty is expressly provided by New Jersey statute,
every person convicted of a violation of the provisions of this article
or any supplement thereto shall be liable to a penalty of not more
than $50 or imprisonment for a term not exceeding 15 days, or both.

person shall park a vehicle at any time upon any of the following

A.
ENGINE-BRAKING
Definitions. As used in this section, the following terms shall have
the meanings indicated:
The use or operation of any mechanical exhaust device designed
to aid in the braking, decompression or deceleration of any motor
vehicle which results in the excessive, loud, unusual or explosive
noise from such vehicle.
B.
Prohibition. It shall be unlawful for the driver of any motor vehicle
to use or operate or cause to be used or operated, at any time and
on any road within the Township of Springfield, any mechanical exhaust
or decompression device which results in the practice known as "engine-braking."
C.
Exceptions. The provisions of this section shall not apply to engine
braking where necessary for the protection of persons and/or property
which cannot be avoided by application of an alternative breaking
system. Noise caused the by application of engine compression brakes,
otherwise known as "engine-braking," which is effectively muffled
or if the application is necessary for the health, safety and welfare
of the community is exempt from the provisions of this section. Sounds
created by emergency equipment for emergency purposes are also exempt.
D.
Posting of signs. The Township is hereby authorized to post at reasonable
locations within the Township signs indicating the prohibition of
engine-braking.
E.
Violations and penalties. Unless another penalty is expressly provided
by New Jersey statute, any person convicted of a violation of this
section shall be punished for a first conviction thereof by a fine
of not more than $100 or by imprisonment for a period not to exceed
10 days, or by both such fine and imprisonment; for a second such
conviction, such person shall be punished by a fine of not more than
$200 or by imprisonment for a period not to exceed 20 days, or by
both such fine and imprisonment; and upon the third or any subsequent
conviction, such person shall be punished by a fine of not more than
$500 or by imprisonment for a period not to exceed six months, or
by both such fine and imprisonment.
A.
Application. This section shall apply to all truck traffic in transit
to or from the Burlington County Solid Waste Facilities Complex (hereafter
the "County Complex") including but not limited to trucks carrying
solid waste. The term "solid waste" shall include trash, garbage,
dewatered and liquid sludge, recyclable materials, leachate, cover
materials (such as soil or clay) whether natural or artificial, or
products for market. The routes established herein are consistent
with the routes established by the County of Burlington.
B.
Exceptions. The mandatory ingress and egress routes to the County
Complex herein established shall not apply to the following vehicles:
(1)
Pickup trucks or utility vehicles driven by employees working at
the County Complex for the purpose of traveling to and from their
employment provided same do not exceed 10 tons GVWR or registered
vehicle weight, whichever is greater.
(2)
Vehicles hauling materials generated within the Township of Springfield.
(3)
Vehicles traveling from the County Complex to a destination within
the Township of Springfield.
(4)
Vehicles carrying waste eligible for disposal at the County Complex's
Convenience Center.
(5)
Emergency vehicles during response to emergencies.
C.
Mandatory access route. All truck traffic in transit to the County
Complex must use Interstate 295, leaving that route at Exit 52 (the
Florence - Columbus Interchange) and traveling east on County Route
656 (Florence - Columbus Road), then turning right onto County Route
656 Spur and County Route 543 (Burlington - Columbus Road) to the
entrance of the County Complex. Except as otherwise provided in this
section, use of any other access route is prohibited.
D.
Mandatory egress route. All truck traffic exiting the County Complex
shall turn right from the gate of the County Complex and travel east
on County Route 543 (Burlington - Columbus Road) turning left onto
County Route 656 Spur and then left again onto County Route 656 (Florence
- Columbus Road) and shall continue west to Interstate 295 where it
shall utilize Interstate 295 to proceed toward its ultimate destination.
Except as otherwise provided in this section, use of any other access
route is prohibited.
E.
Emergencies. During declared emergencies affecting ingress or egress
to the County Complex or at times when the designated routes are closed,
all truck traffic shall use alternate routes as set forth here:
(1)
In the event that any segment of I-295 other than the segment between
Interchanges 47 and 55 is closed, all trucks shall utilize the next
available interchange to access I-295. Such truck traffic shall avoid
use of Springfield Township roads at all times and County roads within
Springfield Township whenever possible.
(2)
In the event of the closure of the northbound lanes of I-295 between Interchanges 47 and 55, trucks travelling north to the County Complex shall use County Route 541 to U.S. Route 130 north via the Burlington By-pass and then take County Route 656 east to access the County Complex as set forth in Subsection C.
(3)
In the event of the closure of the southbound lanes of I-295 between Interchanges 55 and 47, all trucks travelling south to the County Complex shall use U.S. Route 130 south to County Route 656 east to access the County Complex as set forth in Subsection C.
(4)
In the event that a segment of the designated route between Interchange
52 of I-295 and the County Complex is closed, trucks shall exit at
Interchange 52 onto County Route 656 west and turn left onto Old York
Road and then left again onto County Route 543 to the County Complex
entrance.
(5)
In the event of an emergency or route closure not covered by the provisions of Subsection E(1) through (4), above, trucks shall utilize routes specially designated by the Burlington County Office of Waste Management in consultation with the County Director of Public Safety and the Emergency Management Coordinator during such emergency.
F.
Violations and penalties. Any person, firm, corporation or entity
that violates any of the provisions of this section shall, upon conviction,
be subject to the penalties set forth below. Each violation, including
each direction of travel, and each day of violation shall be deemed
to be separate and distinct offenses.
(1)
For a first offense, a fine of $350.
(2)
For a second offense, a fine of not less than $500 nor more than
$750 or imprisonment in the county jail for a period not to exceed
30 days, or both.
(3)
For a third offense, a fine of not less than $1,000 nor more than
$2,000 or imprisonment in the county jail for a period not to exceed
90 days, or both.
G.
Signs. Appropriate signs in accordance with the Manual on Uniform
Traffic Control Devices for Streets and Highways shall be erected
at the entrances to the Township.
