Pursuant to N.J.S.A. 40A:14-146.8 et seq., there is hereby created
the title of Special Police Officer (Class One).
A.Â
Prior to the formal appointment of any candidate, and prior to commencement
of the required training, the Police Director shall name up to 50
persons for potential appointment as Special Police Officer (Class
One). The Chief of Police shall then ascertain the eligibility of
each said prospective appointee in accordance with N.J.S.A. 40A:14-146.10,
regarding required criminal records check and other appointment criteria.

Pursuant to N.J.S.A. 40A:14-146.18, all such prospective appointees
shall be residents of the City of Paterson at the time their eligibility
is ascertained and at the time of appointment. Written records of
all matters determining eligibility shall be retained by the Police
Department as required by law.

The Police Director may appoint up to 50 certified Class One Special
Police Officers, whose appointments are expressly contingent on completion
of the proper special law enforcement training course pursuant to
N.J.S.A. 40A:14-146.11. If a prospective appointee is serving as a
member of the auxiliary police or is a constable, the prospective
appointee must resign from his or her position as a member of the
auxiliary police or as a constable upon successful completion of the
said special law enforcement training course in order to receive an
appointment under this section.
All initial appointments shall be for a term of four months.
Thereafter, any reappointment shall be for a term of one year.
In addition to performing routine traffic details, crowd control,
other routine patrols and similar duties as may be prescribed by the
Chief of Police or his or her designee, such Special Police Officers
(Class One) are hereby specifically authorized to issue summonses
for disorderly persons offenses, petty disorderly persons offenses,
violations of municipal ordinances and violations of Title 39 of the
Revised Statutes. Under no circumstances will such a Special Police
Officer (Class One) be assigned any duties that may require the carrying
or use of a firearm. The duties, assignments, responsibilities and
scheduling of hours of service of such Special Police Officers (Class
One) shall, consistent with the foregoing and all applicable laws
and regulations, be determined by the Chief of Police.
Such Special Police Officers (Class One) shall be compensated
at a rate whose range shall be set by ordinance. The City of Paterson
will reimburse a Special Police Officer (Class One) for costs incurred
for the purchase of any authorized uniforms or equipment that he or
she is expressly required to purchase by the Department of Police.
Upon the resignation, removal, or non-reappointment of a Special Police
Officer (Class One), said officer shall immediately surrender to the
Department his or her shield and insignia of office, together with
any departmental property that may be in his or her possession.
