A. 
The Board of Aldermen may, by special permit after public hearing, authorize the location of any of the following buildings or uses in any district.
1. 
Any public building erected and used by any department of the City, County, State or Federal Government;
2. 
Hospitals, clinics and institutions, provided however, that such buildings or uses will be located upon a lot of sufficient area and shall be of such character that they will not have any serious and depreciating effect upon the value of the surrounding development and, provided further, that the buildings shall be set back from all yard lines a distance of not less than two (2) feet for each one (1) foot of building height;
3. 
Community building or recreation field;
4. 
Nurseries and greenhouses, provided that any such structures shall not be less than one hundred (100) feet from all property lines;
5. 
Outdoor advertising sign on property in residential zoning districts, but not within seventy-five (75) feet of the nearest edge of the right-of-way of an interstate highway and visible from the said highway, subject to the requirements and limitations of Chapter 415 of this Code.

Before issuance of any special permit for any of the buildings in Section 400.1140 or uses, the Board of Aldermen shall refer the proposed application to the Planning Commission. The Commission shall be given sixty (60) days in which to make a report regarding the effect of such proposed buildings or use upon the character of the neighborhood, traffic conditions, public utility facilities and other matters pertaining to the general welfare. No action shall be taken upon any application for a proposed building or use above referred to until and unless the report of the Planning Commission has been filed. If no report is received from the Planning Commission within sixty (60) days, it shall be assumed that the application has been recommended by the Commission.
