The following words, terms and phrases, when used in this Article, shall have the meanings ascribed to them in this Section, except where the context clearly indicates a different meaning:
BUSINESS or OCCUPATION
Every person engaged in any business, occupation, pursuit, profession or trade or in keeping or maintaining of any institution, establishment, article, utility or commodity specified in this Article or in any other ordinance of the City within the City except as may be otherwise provided by law.
PIN BALL MACHINES
Any mechanical or electronic amusement device which, upon insertion of a coin slug, token, card, plate or disc, may be operated by the public for use as a game, entertainment or amusement, whether or not registering a score.

No person, firm, corporation, partnership or trustee shall engage in any of the various businesses, employments, agencies, amusements or exhibitions or service type business, own, manage, operate or control any public buildings, public halls or any of the other matters hereinafter listed, unless such person, firm, corporation, partnership or trustee shall first apply for and obtain a license.

The application for such license shall be filed with the City Clerk. The City Clerk shall submit the application to the Board of Aldermen who shall consider the application. If they find that the applicant complies with all laws and ordinances, the Board of Aldermen shall approve the license and direct the City Clerk to issue the license. If the Board of Aldermen shall initially determine that the license should not be granted, the Board should notify the applicant of the date for a hearing, at which hearing evidence shall be submitted to the Board by the City Attorney and may be submitted by the applicant. A transcript shall be made of such hearing and the Board of Aldermen shall issue its findings of fact, conclusions of law and to the address shown on the application. Any appeal shall be taken to the St. Louis County Circuit Court pursuant to Chapter 536, RSMo.

The following businesses and occupations shall pay annual license fees as indicated, except that any business or occupation for which a set fee is indicated shall pay at least five dollars ($5.00) for every person regularly employed or associated in such business during the preceding license year and the license fee shall be the higher of the set fee or the computed fee. The license for a new business shall be based upon an estimate of regular employees or associates of the businesses during the license year. A regular employee or associate shall be one who works in the service of the licensee twenty (20) hours or more per week during thirty (30) or more weeks per year.

A. 
No person following for a livelihood the profession or calling of minister of the gospel, duly accredited Christian Science practitioner, teacher, professor in a college, priest, lawyer, certified public accountant, dentist, chiropractor, optometrist, chiropodist, or physician or surgeon in this City shall be taxed or made liable to pay any municipal or other corporation tax or license fee of any description whatever for the privilege of following or carrying on such profession or calling, and after December 31, 2003, no investment funds service corporation as defined in Section 143.451, RSMo., may be required to pay any such license fee in excess of twenty-five thousand dollars ($25,000.00) annually, any law, ordinance or Charter to the contrary notwithstanding.
B. 
No person following for a livelihood the profession of insurance agent or broker, veterinarian, architect, professional engineer, land surveyor, auctioneer, or real estate broker or salesman in this City shall be taxed or made liable to pay any municipal or other corporation tax or license fee for the privilege of following or carrying on his/her profession unless that person maintains a business office within the City of Cool Valley.

All licenses herein mentioned which shall be issued for the term of less than a year become due and payable on the first (1st) day of March of each year and upon the failure of any person, firm or corporation to secure the same, such person, firm or corporation shall be prosecuted for failure to do so.

It shall be the duty of the City Clerk to furnish blanks for licenses which shall be on file in the City Clerk's office.

Whoever shall obtain a license under the provisions of this Article shall keep the same posted in a conspicuous place so that it may be seen readily by any Police Officer or any officer or official of the City.
