Section 640.010 Permit Required.

Any person engaged in a vehicle for hire business or operating a vehicle for hire within the corporate limits of the City shall first obtain a permit therefore in compliance with the provisions of this Chapter.

Section 640.020 Definitions.

For the purpose of this Chapter, the following terms shall have the meanings designated herein:
DRIVER
Every person physically in charge of, operating or driving a vehicle for hire. A driver shall only be a person and shall not be a business entity.
DRIVER'S PERMIT
A permit granted by the City to a qualified driver of a vehicle for hire.
OWNER
Any person or entity having:
1. 
Ownership or control of a business which, in whole or in part, operates one (1) or more vehicles for hire, and/or
2. 
Is the owner of one (1) or more vehicles used as a vehicle for hire.
OWNER'S PERMIT
A permit granted by the City to the person or entity having:
1. 
Ownership or control of a business which, in whole or in part, operates one (1) or more vehicles for hire, and/or
2. 
Is the owner of one (1) or more vehicles used as a vehicle for hire.
STREET
Any street, alley, avenue, lane, public place or highway in the City.
VEHICLE FOR HIRE
Any motor vehicle used to transport persons from one point to another for which the driver and/or owner directly or indirectly receives compensation including, but not limited to, limousines and/or taxicabs. For these purposes, vehicles for hire shall not include school buses, medical assistance vehicles or other government funded transportation assistance vehicles.

Section 640.030 Applications.

A. 
Any person or entity desiring to:
1. 
Own or control a business which, in whole or in part, operates one (1) or more vehicles for hire within the City, or
2. 
Own one (1) or more vehicles used as vehicles for hire within the City, shall file with the City Clerk a written application for an owner's permit therefore giving the following information:
a. 
The full name and address of the principal place of business and other pertinent information of the applicant, and if a partnership, the name and residence address of all partners, and if a corporation, the name and residence address of the officers and directors; the trade name under which the applicant does or proposes to do business; the Social Security number and date of birth of the applicant, and if a partnership or corporation then the tax identification number of the applicant.
b. 
The number of taxicabs actually owned by the applicant and the number held by it under lease, if any.
c. 
A list shall be provided of any misdemeanor or felony convictions of applicant.
d. 
A release authorizing the City of Maryville to obtain records of all misdemeanor or felony convictions from any and all States and the United States.
e. 
The make and model, vehicle identification numbers (VIN) and the registered owner of each proposed vehicle for hire. If vehicle make, model, the State automobile license number and vehicle identification on the application changes at any time prior to or after the actual issuance of the owner's permit by the City Clerk, it shall be the responsibility of the owner to provide updated information.
f. 
Such application shall be sworn to contain full, true and complete answers and signed before a notary public.
g. 
Evidence of current proof of financial responsibility as required by Section 640.050.
B. 
Any person desiring to be physically in charge of, operate or drive a vehicle for hire within the City shall file with the City Clerk a written application for a driver's permit therefore, providing the following information:
1. 
The full name, residence address, Social Security number, driver's license State of origin and number and the date of birth of the applicant.
2. 
A list shall be provided of any misdemeanor or felony convictions of applicant.
3. 
A list of all States in which the applicant has held a license to operate a motor vehicle.
4. 
The person or entity who owns the vehicle(s) for hire and who operates the vehicle for hire business for whom such applicant is to be employed and the address of the principal place of business of such person or entity.
5. 
A copy of the applicant's current driver's license.
6. 
A release authorizing the City of Maryville to obtain records of all misdemeanor or felony convictions and driving records from any and all States and the United States.
7. 
Such application shall be sworn to contain full, true and complete answers and signed before a notary public.
C. 
Any person desiring to renew an owner's permit or driver's permit shall complete the same requirements as those applying for a new owner's permit or driver's permit.

Section 640.040 Investigation of Application for Owner's and Driver's Permits.

A. 
The Director of Public Safety shall supervise an immediate, thorough investigation of each owner's and/or driver's permit application received hereunder for the purpose of investigating the criminal history and driving record history of the applicant. The Director shall forward his findings to the City Clerk who shall determine whether the criminal and/or driving record history complies with the requirements of this Chapter.
B. 
In an effort to offset the expense of the investigation process, applicants shall pay a non-refundable investigation fee of twenty-five dollars ($25.00), whether applying for or renewing an owner's permit, driver's permit, or both.
C. 
License renewals shall be submitted no later than January first (1st) of each even-numbered year (renewal every two (2) years).

Section 640.050 Insurance Requirements.

A. 
Every holder of an owner's permit shall at all times maintain financial responsibility, as described in Chapter 303, RSMo., for each vehicle for hire.
B. 
Every holder of a driver's permit shall at all times carry in the vehicle for hire operated by such permittee proof of financial responsibility in accordance with Sections 303.024 and 303.160, RSMo.
C. 
Evidence of insurance coverage as described in Section 303.024, RSMo., shall be presented to the City Clerk at the time applicant applies for an owner's permit. It shall be the responsibility of such permittee to keep the insurance coverage in full force and effect during the term of the owner's permit and to present to the City Clerk evidence of any renewal of such insurance coverage which occurs during the term of such permit. Such certificate shall provide that thirty (30) days' advance written notice shall be given to the City in the event of any change in or cancellation of such insurance.

Section 640.060 Issuance of Permit.

A. 
No person shall be issued or renewed a driver's permit if they have been convicted of, plead guilty to or found guilty of any of the following:
1. 
Any crime described in Sections 565.020 through 565.060, RSMo. (homicide and assault); Sections 565.180 through 565.184, RSMo. (elder abuse); Sections 566.030 through 566.095, RSMo. (sexual offenses); Sections 568.045 through 568.090 and 568.175, RSMo. (child abuse and exploitation); Sections 569.020 and 569.030, RSMo. (robbery); and Sections 573.023, 573.025, 573.035, 573.037 and 573.040, RSMo. (child pornography).
2. 
Any municipal, State or Federal crime which contains all elements of any Missouri Statute described in the previous Subsection.
B. 
No person shall be issued a driver's permit if their driving privileges are suspended or revoked in this or any other State for any reason.
C. 
No applicant shall be issued a driver's permit who has been convicted in any municipal or State court of driving while intoxicated (DWI) or have had his license suspended or revoked as a result of an alcohol-related offense within three (3) years of applying for a driver's permit.
D. 
Upon satisfactory completion of all requirements set forth in this Chapter, the City Clerk shall in due course grant the applicant an owner's permit and/or driver's permit, as the case may be.
E. 
An owner's permittee shall notify the Clerk within seven (7) days if a change occurs in the number of vehicles for hire, the ownership of any or all vehicles for hire, any acquisition of or disposal of a vehicle for hire, or the conviction of any crime by any driver's permittee employed by owner which would prohibit such permittee from maintaining his driver's permit. A failure to do so shall constitute grounds for revocation or suspension of said owner's permit.
F. 
If, while in possession of a valid driver's permit, a permittee shall be found to be in violation of Subsections (A), (B) and/or (C) of this Section, then such permittee's driver's permit shall be revoked.

Section 640.070 Driver's Permit Requirements.

A. 
All drivers' permittees shall possess a valid Class "E" Missouri driver's license.
B. 
No persons under eighteen (18) years of age shall be issued a driver's permit.
C. 
The City of Maryville shall provide qualified applicants a driver's permit which contains a photograph of the permittee upon payment by the qualified applicant of a license fee to the City of fifteen dollars ($15.00) to cover the cost of preparing the permit. A driver's permittee shall post in plain sight of passengers his driver's permit at all times in which he is operating a vehicle for hire.

Section 640.080 Revocation or Suspension.

A. 
Upon notice and hearing conducted in the manner described in Section 600.250(B) through (J), the City Council may revoke or suspend an owner's or driver's permit, or both, issued under the provisions of this Chapter upon finding that one (1) or more of the following has occurred:
1. 
Failure of the owner's permittee to conduct his vehicle for hire business for a period of sixty (60) days or longer.
2. 
Violation of any portion of this Chapter of the Maryville Municipal Code by the owner's or driver's permittee.
3. 
Allowance by an owner's permittee of a non-permitted person to operate owner's vehicle for hire.
4. 
Operation of vehicle for hire business without proof of insurance on file with the City Clerk as prescribed in this Chapter.
5. 
Aiding, abetting or assisting the promotion of advancement of any illegal or immoral activity, affair or business.
6. 
Falsifying or omitting information on any application required by this Chapter.
7. 
Any act which would have prevented a driver's permittee from initially obtaining or renewing such permit under Section 640.060 hereof had such act occurred prior to the issuance or renewal of the permit.

Section 640.090 Effect on Court Proceedings.

The penalty established by the City Council by the suspension or revocation of a permit pursuant to this Chapter shall not limit or effect the authority of any other administrative body or any court to establish an additional, separate penalty or punishment for the same conduct.

Section 640.100 Penalty.

Any person who violates any provision of this Chapter or any Section thereof shall, upon conviction thereof, be punished by a fine not to exceed five hundred dollars ($500.00) or by imprisonment for not more than three (3) months, or by both such fine and imprisonment. A separate offense shall be deemed committed upon each day or part of a day during or on which any person violates any provision of this Chapter.
