It is hereby found, determined and declared to be necessary
for the public health, safety, welfare and benefit of the City and
its inhabitants that the waterworks and the sewerage system of the
City, including all future improvements and extensions thereto, be
combined and that they shall henceforth be operated and maintained
as a Combined Waterworks and Sewerage System.

A.
Henceforth,
from and after the final passage of this Title, (May 11, 1992), the
waterworks and the sewerage system of the City, including all future
improvements and extensions thereto, whether to the waterworks or
to the sewerage system or to both, shall be and the same are combined,
and it is hereby declared that said waterworks and said sewerage system,
including all future improvements and extensions thereto as aforesaid,
henceforth shall be operated and maintained as a Combined Waterworks
and Sewerage System.
B.
It
is determined and declared to be necessary and conducive to the protection
of the public health, safety, welfare and convenience of the City
to collect rates, fees and charges for the use of and services provided
by the System. The proceeds of such charges so derived will be used
for the purpose of operating and maintaining the System; paying the
principal of and interest on all revenue bonds or other obligations
of the City now outstanding or hereinafter issued or incurred ("Revenue
Bonds", as hereinafter defined) that are payable solely from the revenue
of the System (the "System Revenues", as hereinafter defined); and
providing funds sufficient to meet the requirements of the ordinances
of the City authorizing the issuance of the Revenue Bonds (the "Bond
Ordinances", as hereinafter defined), including replacement of the
System.

A.
No
individual or entity, including the City of Maryville Water Department,
the Nodaway County Public Water Supply District No. 1, nor any other
person(s) or entity shall construct or attempt to construct a public
water main within the corporate limits of the City of Maryville, Missouri,
unless and until all of the following requirements have been satisfied:
1.
A complete set of construction and building plans and specifications
must be submitted in advance to the engineer designated by the City
of Maryville and receive written approval from the engineer.
2.
Said construction and building plans and specifications must be submitted
to the Missouri Department of Natural Resources Public Drinking Water
Program and said Department of Natural Resources has issued all appropriate
permits required by all Federal and State laws and/or regulations.

A.
In
August of every year and in conjunction with the review of the annual
budget, the City Manager shall submit a report to the Council of the
City of Maryville, Missouri, concerning the adequacy of municipal
water rates. The report shall, as a minimum, address the following
concerns:
1.
An estimate of the total revenues generated by municipal water rates
during the present budget year from all sources of revenue.
2.
An estimate of the municipal water revenues to be generated in the
coming budget year.
3.
An estimate of the total expenditures incurred by the water utility
during the present budget year.
4.
A statement of all funds placed in a reserve account during the present
budget year for replacement of all equipment and facilities at the
Municipal Water Treatment Plant.
5.
A statement of the funds to be placed in the reserve account during
the next budget year for the replacement of all equipment and facilities
at the Municipal Water Treatment Plant.
6.
A statement of all funds placed in a reserve account during the present
budget year for replacement of all components of the water distribution
system.
7.
A statement of the funds to be placed in the reserve account during
the next budget year for the replacement of all components of the
water distribution system.
B.
Based
on the above-cited data, the City Manager shall prepare a report which
analyzes the adequacy of the City's water rates to meet the spending
and savings goals for the next budget year. The City Manager shall
make a recommendation for changing water rates adequate to meet such
spending and savings goals.
C.
Upon
receipt of the City Manager's report, the Council of the City of Maryville,
Missouri shall set municipal water rates to enable the City to meet
its budgetary goals for spending and payment to all reserve accounts.

A.
General. This Water Conservation Plan provides guidelines
for the implementation of water conservation measures by customers
who receive potable water originating at the Water Treatment Plant
of the City of Maryville, Missouri. In order to provide an adequate
supply of potable water for human consumption, and to protect the
health, safety and welfare of those who rely upon ready availability
of water produced at the Maryville Water Treatment Plant, conservation
measures will be implemented in phases. The use of a graduated process
will serve to address crisis conditions by responding with conservation
measures necessary to address the situation which result in the minimum
impact on water use by customers.
B.
BASE MONTH
CITY
CITY MANAGER

WATER
Definitions. The following terms as used in this
Plan shall have the following meanings:
The most recent, similar non-drought month. The base month
shall be designated by the City Manager upon implementation of Phase
4 of the Plan. For purposes of illustration, if the phase was implemented
in July 2000, the base month would be the most recent July or similar
water use month which was not impacted by a drought or other, similar
factors.
The City of Maryville.
The Chief Administrative Officer of the City, including the
City Manager, Acting City Manager or his/her designee.
The Maryville Water Treatment Plant.
Potable (treated) water processed at the Maryville Water
Treatment Plant.
C.
Phases Of Conservation.
1.
Voluntary conservation — public agencies and large
users.
a.
Threshold. Based upon information provided by the Superintendent of the Maryville Water Treatment Center, Subsection (C)(1) may be implemented at the direction of the City Manager when the City Manager concludes that the daily demand for water by customers of the City is anticipated to exceed the amount of water that can be produced by the plant during that demand period.
b.
Notification. Contact shall be made with the
largest users of water from the City, and with all public agencies
and governmental units who use water treated by the City.
c.
Plan. Customers contacted under this phase
shall be requested to immediately implement voluntary methods to reduce
their use of water which is treated at the Maryville Water Treatment
Plant, including both actual reduction of water use and implementation
of procedures designed to delay water demand during peak demand periods.
2.
Voluntary conservation — all users.
a.
Threshold. Subsection (C)(2) may be implemented at the direction of the City Manager when the actual daily demand for water by customers of the City exceeds the amount of water that was produced by the plant during that demand period.
b.
Notification. Informational notices and news
releases on water conservation shall be distributed, and such additional
contacts with water users will be made as deemed appropriate.
c.
Plan. All who receive water from the Maryville
Water Treatment Plant, including individuals, businesses, industries,
public agencies, governmental units and institutions shall be requested
to immediately implement voluntary methods to reduce their use of
water treated at the Maryville Water Treatment Plant, including reduction
of water use and implementation of procedures designed to delay water
demand during peak demand periods.
3.
Mandatory restriction on outdoor water use.
a.
Threshold. Subsection (C)(3) shall be implemented at the direction of the City Manager when the City of Maryville is unable to maintain a twenty-four-foot water level at either the Edwards Street Water Tower, North Water Tower, or South Water Tower for a continuous period which exceeds twenty-four (24) hours.
b.
Notification. Informational notices and news
releases shall be distributed, and such additional contacts with water
users will be made as deemed appropriate.
c.
Plan.
(1)
Customers who receive water from the Maryville
Water Treatment Plant shall be directed to implement further methods
of water conservation, including actual reduction of water demand;
(2)
The use of water which has been treated at the
Maryville Water Treatment Plant for any outdoor use is prohibited.
This prohibition includes watering of lawns, gardens, shrubs, other
vegetation, washing of sidewalks, driveways and motor vehicles. However,
this prohibition shall not apply to the use of water for washing motor
vehicles at a commercial car wash business, nor the use of water for
the watering of livestock or vegetation at a commercial business.
(3)
All business and commercial customers, industries,
public agencies, governmental units and institutions, and all large
users of water shall be directed to prepare for the potential of further
water restrictions, including being advised to make arrangements to
obtain potable (treated) water from sources other than the City of
Maryville;
(4)
Pursuant to ordinance, officers of the Maryville
Public Safety Department shall issue a summons for any violation of
this phase of the Water Conservation Plan.
4.
Mandatory restriction to base month demand.
a.
Threshold. Subsection (C)(4) shall be implemented at the direction of the City Manager when the City of Maryville is unable to maintain a twenty-two-foot water level at either the Edwards Street Water Tower, North Water Tower, or South Water Tower for a continuous period which exceeds twenty-four (24) hours.
b.
Notification. Notices shall be issued to all
business and commercial customers, industries, public agencies, governmental
units and institutions and large users of water produced at the Maryville
Water Treatment Plant. Said notices shall advise each of the requirements
of Phase 4, and shall advise each of their maximum allowable daily
and monthly water use level based upon the applicable base month.
c.
Plan.
(2)
The use of water which has been treated at Maryville
Water Treatment Plant by the commercial car wash business, for the
commercial watering of livestock or for the commercial watering of
vegetation is prohibited;
(3)
The use of water treated at the Maryville Water
Treatment Plant on both a daily and monthly basis by any business
or commercial customer, industry, public agency, governmental unit
or institution shall not exceed their average level of water use during
the designated base month;
(4)
Pursuant to ordinance, officers of the Maryville
Public Safety Department shall issue a summons for any violation of
this phase of the Water Conservation Plan.
d.
Penalty. Any water customer who exceeds the
base level use limitation implemented by this phase shall have a surcharge
added to its water bill equal to fifty percent (50%) of the total
monthly bill.
5.
Mandatory rationing — reduction to seventy-five
percent (75%) of base month demand (non-domestic users):
a.
Threshold. Subsection (C)(5) is implemented at the direction of the City Manager when the City of Maryville is unable to maintain a twenty-foot water level at either the Edwards Street Water Tower, North Water Tower, or South Water Tower for a continuous period in excess of twenty-four (24) hours.
b.
Notification. Notices shall be issued to business
and commercial customers, industries, public agencies, governmental
units and institutions and domestic users, notifying them of the requirements
and penalties associated with this phase, and insuring that each is
aware of its maximum allowable daily and monthly use level based upon
the applicable base month.
c.
Plan.
(2)
The use of water treated at the Maryville Water
Treatment Plant on both a daily and monthly basis by any business
or commercial customer, industry, public agency, governmental unit
or institution shall not exceed seventy-five percent (75%) of its
allowable water use level during the designated base month;
(3)
Pursuant to ordinance, officers of the Maryville
Public Safety Department shall issue a summons for any violation of
this phase of the Water Conservation Plan.
d.
Penalty. Any water customer who exceeds the
limitation to seventy-five percent (75%) of base water level use implemented
by this phase shall have a surcharge added to the water bill equal
to seventy-five percent (75%) of its total monthly bill.
6.
Cessation of commercial and industrial usage and ration
domestic usage.
a.
Threshold. Subsection (C)(6) shall be implemented at the direction of the City Manager when the City of Maryville is unable to deliver treated water to its customers at the level necessary to provide adequate pressure within the City's water distribution system in order to prevent back flow situations.
b.
Notification. Notices will be made as follows:
(1)
All business or commercial customers, industries,
public agencies, and governmental units and institutions will be notified
that their water service by the City of Maryville is terminated, and
they should immediately utilize alternative sources for potable (treated)
water;
(2)
Domestic users will be notified of the requirements
and penalties associated with this phase.
c.
Plan.
(1)
Use of water which has been treated at the Maryville
Water Treatment Plant at any business or commercial customer, industry,
public agency, governmental unit or institution is prohibited.
(2)
The use of water treated at the Maryville Water
Treatment Plant on both a daily and monthly basis by domestic users
shall not exceed fifty percent (50%) of their allowable water use
level during the designated base month.
d.
Penalty. Any water customer who exceeds the
limitation to fifty percent (50%) of base water level use implemented
by this phase shall have a surcharge added to the water bill equal
to one hundred percent (100%) of its total monthly bill. Additionally,
any user who exceeds this limitation shall be immediately disconnected
from water service.
D.
Uses Exempt From This Plan. In addition to any exemptions
described above, the following shall be exempt from the provisions
stated in this Plan, although each exempt user shall be requested
to implement voluntary methods to reduce its use of water treated
at the Maryville Water Treatment Plant, including both actual reduction
of water use and the implementation of procedures designed to delay
water demand during peak periods:
1.
St. Francis Hospital & Health Services and any other hospital;
2.
All nursing homes and other institutions identified by the City
Manager as being directly involved in the delivery of health care
services;
3.
Any specific use as approved by the City Manager, including
any critical system facility which is identified;
4.
The Fire Division of the Maryville Public Safety Department;
5.
The Polk Township Volunteer Fire Department.
