A. 
The International Code Council (I.C.C.), formerly known as the Building and Code Administration (B.O.C.A.), has outlined safety standards for swimming pool fencing in an effort to eliminate or reduce the accidental drowning of children.
B. 
A fence permit from the City Building Inspector/Code Enforcement Officer is required. A final inspection will be conducted by the Building Inspector to assure all highlights have been met.
C. 
The guidelines listed below shall be adhered to by any property owner engaging in all new and modification, construction, installation or erection of any structure surrounding any body that holds water for a period of greater than twenty-four (24) hours. Failure to comply with the safety standards may be punishable by a fine not to exceed five hundred dollars ($500.00).

1. 
Minimum height of forty-eight (48) inches.
2. 
Fence shall surround the entire property or the pool area. Fencing shall be chain link, wood or plastic privacy or other approved material, as set forth in this Code.
3. 
Gates in fencing shall be self-closing and have self-latching devices. Gates shall open out away from the pool area, subject to the other provisions of this Section.
4. 
When the swimming pool structure itself is used as the required barrier, the following conditions shall be met:
a. 
The walls of the swimming pool shall be a minimum of forty-eight (48) inches in height above grade.
b. 
The ladder to the swimming pool shall be capable of being secured, locked or removed to prevent access; or the ladder or steps shall be surrounded by a barrier meeting the requirements for fencing.
5. 
Decks surrounding the pool may be used as protective barriers provided they are constructed in accordance with the Building Code and have guardrail heights of forty-eight (48) inches. Access stairs and gates to the deck must meet the requirements for fence gates.
6. 
No "kiddie" pool, plastic, vinyl, or blow-up, shall be left unattended and/or unfenced unless pool is completely empty or is within a fenced area as prescribed by this Section.
D. 
For existing residential swimming pools, spas or hot tubs, permanently erected, constructed or installed on private property, prior to the date of enactment of this Section, if the existing barrier/fencing installed does not meet the regulations contained herein, said property owner shall be exempt from the provisions of Subsection (C) of this Section, until such time as the barrier/fencing installed is replaced or substantially modified.
