A.

A. 
Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of a provision of this article or any supplement thereto shall be liable to a penalty of not less than $25 nor more than $75; upon a second violation, a fine in an amount not less that $75 nor more than $150; and upon a third violation, a fine in an amount not less than $150 nor more than $300; and upon a fourth or subsequent violation, a fine in an amount not less than $300 and not more than $500; and/or, for each such violation, a period of community service not to exceed 10 days. Whenever such person shall have been officially notified by service of a summons in a prosecution, or in any other official manner, that said person is committing a violation, each day's continuance of such violation after such notification shall constitute a separate offense, punishable by a like fine or penalty.
B. 
Fraudulent use of a residential parking permit, making a counterfeit residential parking permit or altering or defacing a validly issued residential parking permit shall be punishable by a fine not to exceed $300 and revocation of the permit.
A. 
Residential parking permits will be issued to the vehicle described and the person named in the application.
B. 
A residential parking permit allows a vehicle/person to be exempted from the residential-parking-permit-only parking restriction. The issuance of a residential parking permit does not guarantee or reserve an on-street parking space.
C. 
Residential parking permits will be issued only to those residents who complete an application utilized by the Somers Point Police Department which will require, at a minimum, the following information and such other information as the Somers Point Police Department may, from time to time, deem appropriate:
(1) 
Applicant information, including name, address, contact numbers, driver license number and expiration date, true copy of valid driver's license;
(2) 
Vehicle information, including color, make, model, year, license plate and state of issuance, true copy of registration, registration expiration date, name of insurance company, policy number, true copy of insurance certificate, name and address of registered owner, contact information for registered owner if other than applicant. If the owner of a subject vehicle is a leasing company, or the employer of the resident applicant, or is registered to a relative whose name is different from that of the applicant, a notarized letter from the owner, explaining the relationship between owner and applicant and confirming that the named applicant has exclusive use of the vehicle for which a permit is requested;
(3) 
Proof of residence on the side or sides of a street which is designated as being subject to parking by residential parking permit only which may be:
(a) 
Property deed;
(b) 
Lease agreement if a tenant or subtenant;
(c) 
Utility company bill showing the applicant's name as residing at the address in question.
D. 
Each residential parking permit shall be valid only for the vehicle listed on the application. If a resident changes vehicles, he or she must provide proof or change to the Chief of Police or his/her designee, and an updated permit will be issued for the duration of the then-current term at no cost.
E. 
Residential parking permits are valid only within the designated areas on the street where the applicant resides and may not be used on any other street or restricted area.
F. 
A residential parking permit does not permit the parking of any vehicle which is otherwise prohibited under any other article of Chapter 250 of the Somers Point Municipal Code, including but not limited to vehicles in excess of allowed weight.
G. 
Each permanent resident within each designated residential parking permit zone will be eligible to receive one resident parking permit for each vehicle registered to a permanent resident at that address.
H. 
Each residence address within each designated residential parking permit zone will be eligible to receive one annual guest pass which shall be limited to not more than seven consecutive calendar days by each resident guest and is not to be used by a resident of the household. Abuse of this requirement will be cause for revocation of the annual guest pass.
I. 
Each residence address within each designated residential parking permit zone may make application for a temporary guest pass which shall be valid for up to seven consecutive calendar days for use by visitors, guests, family members, visiting repairmen and contractors and other similar visitors.
J. 
Residential parking permits are not transferable.
K. 
When a vehicle is parked during the restricted period, the residential parking permit must be visibly displayed in the registered vehicle in the manner prescribed by the Somers Point Police Department.
L. 
The Somers Point Police Department will investigate each application to determine if the application is accurate, complete and the applicant satisfies the criteria for issuance of the residential parking permit.
M. 
All residential parking permits will be issued by the office of the City Clerk upon receipt of an application approved by the Chief of Police or his/her designee.
N. 
The City of Somers Point will not be responsible for damaged, lost or stolen permits which must be promptly reported to the City Clerk or the Chief of Police.
O. 
Residential parking permits will be issued on an annual basis to be effective commencing on January 1, 2022, and expiring on December 31, of each calendar on which same was issued. Any permits issued prior to said effective date with an expiration date of August 31, 2022, shall hereby automatically be extended to December 31, 2022.

P. 
The following fee Schedule shall be in effect upon the effective date of this article:
(1) 
Each residential parking permit fee: $10.
(2) 
Each annual guest pass: $10.
(3) 
Each temporary guest pass: $ 5.
(4) 
Replacement of a residential parking permit or permanent guest pass: $50.
Q. 
Notwithstanding anything elsewhere contained within this § 250-56, within the designated area of Bay Avenue described in § 250-54A:

(1) 
Only one residential parking permit will be issued to any single street address and only for a single vehicle from each address in compliance with the intent of Ordinance 18 of 1999; and
(2) 
The three residential properties for which such residential parking permits may be issued are designated as 814, 816 and 820 Bay Avenue.

A. 
Authorization. The governing body of the City of Somers Point shall establish, in accordance with N.J.S.A. 39:4-197.6, restricted parking zones in front of residences occupied by handicapped persons, provided that:
(1) 
Such persons are holders of current drivers' licenses issued by this state.
(2) 
The motor vehicles to be parked in such zones are equipped with special attachments and devices as the Director of the Division of Motor Vehicles may deem necessary to provide for the safe operation thereof by such persons.
(3) 
Such parking is not otherwise prohibited and the permitting thereof would not interfere with the normal flow of traffic.
B. 
Definitions. For the purpose of this section, the following terms shall have the meanings indicated:
HANDICAPPED PERSON
Includes any person, male or female, who has sustained an amputation of either or both legs, or of parts of either or both legs, or of either or both arms, or parts of either or both arms, or who has been otherwise disabled in any manner rendering it difficult and burdensome for him to walk.
C. 
Special vehicle identification card required. Any person requesting such a restricted parking zone in the City of Somers Point shall have first applied to the Director of Motor Vehicles in the Department of Law and Public Safety of the State of New Jersey and shall have received a special vehicle identification card and certificate to be pasted on the windshield of the car, as provided for by the Revised Statutes in Title 39.
D. 
Presentation of request. The handicapped person shall then submit a request in writing for the desired parking zone to the City Clerk's office, who shall present same to the City Council at the next regularly scheduled meeting. This request shall have a copy of the New Jersey identification card attached thereto.
E. 
Letter of approval. Upon the approval of such request by the City Council of the City of Somers Point, the City Clerk shall provide the Chief of Police with a letter of approval and the address for the parking zone.
F. 
Designation of area; sign and permit. The Traffic Division of the Police Department in conjunction with the City Engineer shall provide:
(1) 
An area of 25 feet in length in front of the residence of the handicapped persons, to be painted as a no-parking zone.
(2) 
A "Handicapped Parking By Permit Only" sign to be placed alongside the designated area.
(3) 
A permit 5 1/2 inches by 8 1/2 inches in size, bearing an appropriate certification of authenticity.
G. 
Display of permit. The permit issued by the City to the handicapped person shall be displayed prominently within the vehicle when it is parked in the designated area so as to be seen from the middle of the street. Only cars which have such a permit properly displayed shall be permitted to be parked in the restricted parking zone indicated on such permit.
H. 
Change of residence or vehicle registration number. A holder of a City handicapped parking permit issued pursuant to this chapter must notify the City Clerk immediately if such person changes his or her residence, changes his or her vehicle registration number, or if the special vehicle identification card and certificate issued by the Director of Motor Vehicles shall be modified, revoked or expired.
I. 
Fee for City permit.
(1) 
The fee for the issuance of such permit shall be $10 per year to be charged to any person entitled to same under the conditions of this chapter.
(2) 
The City Council shall have the authority, by resolution, to amend from time to time the fee to be paid.
J. 
Violations and penalties. Any person parking a motor vehicle in a restricted parking space without a special vehicle identification card shall be liable to a fine of $250 for the first offense and, for subsequent offenses, a fine of at least $250 and up to 90 days' community service on such terms and in such form as the court shall deem appropriate, or any combination thereof.
