No person shall carry on, conduct or engage in the business of supplying gas for compensation in the City, without first having obtained a license to do so.

Every person who shall carry on, conduct or engage in the business of supplying gas for compensation in the City shall pay to the City as a license tax a sum equal to three dollars ($3.00) for each customer in the City who shall purchase gas supplied by such person during the period for which such license shall be issued.

The tax required by this Chapter shall be in lieu of any other occupation tax required of any person engaged in the business described in this Chapter.

A. 
Every person engaged in the business of supplying gas for compensation in the City shall, on or before February 2, in each year, or on or before the day upon which such person first engaged in the business of supplying gas for compensation in the City and thereafter on or before February 2, of each year, file with the City Clerk an application, in writing, for a license to conduct such business in the City for a period of one (1) year, ending upon December 31, such application being in words and figures as follows:
"Comes now _______________________, a corporation, duly organized and existing under and by virtue of the laws of the State of ______________, duly authorized and licensed to do business in the State of Missouri, with the authority to sue and be sued as such, hereby files its application in writing for a license to conduct a business, the purpose of which is to supply gas for compensation, within the City of Fredericktown, in Madison County, State of Missouri, and states as follows, to-wit:

That the said applicant submits herewith the sum of one thousand dollars ($1,000.00) and agrees to the following terms:
a.
That on or before the twentieth day of the month following that which said license shall expire, the applicant hereby agrees to submit to the City Clerk of the City of Fredericktown a sworn statement setting forth the actual number of customers purchasing gas supplied by the applicant during the calendar month within the period during which the license was in effect.
b.
That said license tax to be paid by this applicant shall be determined by multiplying the number of customers that are shown in the statement herein provided for by the sum of three dollars ($3.00) and if the sum thus obtained shall exceed the sum of one thousand dollars ($1,000.00) the applicant herein agrees that it will pay to the City of Fredericktown, Missouri, the difference hereby obtained; and it is also understood that if the total license tax obtained, as hereinbefore provided, shall not equal the sum of one thousand dollars ($1,000.00), the City of Fredericktown shall refund to the applicant the entire amount over and above the license, or the difference between the license tax and the sum of one thousand dollars ($1,000.00) that is paid at the time of the filing of the application. The applicant agrees to permit the City Clerk of the City of Fredericktown, Missouri, or any other person authorized by the Board of Aldermen of said City to have free access at all reasonable times to the books and records of this applicant, for the purpose of verifying the correctness and accuracy of the statement required to be made by Section 620.050 of the Fredericktown City Code.

The applicant makes this application with the understanding that the tax paid as herein provided for shall be paid in lieu of any and all other taxes including occupation tax that may be required by the City of Fredericktown.

B. 
At the time such application shall be made to the City Clerk, the applicant shall pay to the City Collector, before the issuance of the license as herein provided, the sum of one thousand dollars ($1,000.00), and upon payment thereof, the City Clerk shall issue to such person a license entitling such person to conduct such business in the City for a period of twelve (12) months.

A. 
On or before the 20th day following the date upon which the license required by this Chapter shall expire, the person holding a license to engage in the business of supplying gas for compensation in the City shall file with the City Clerk a sworn statement setting forth the actual number of customers purchasing gas supplied by such person in the City during each calendar month within the period during which such license was in effect. The number of customers as shown in such sworn statement for each of the several months shall be averaged to determine the average number of customers for the period during which such license was in effect, and the license tax shall be based upon the average number of customers so determined, at the rate of three dollars ($3.00) for each customer.
B. 
If the total license tax thus determined shall be less than the sum of one thousand dollars ($1,000.00), paid by the licensee upon the issuance of the license, the City shall refund to the licensee a sum equal to the difference between such one thousand dollars ($1,000.00) and the amount due as shown by such sworn statement. If the total license tax as shown by such sworn statement shall be in excess of one thousand dollars ($1,000.00), paid by the licensee upon the issuance of the license, the licensee shall, at the time of filing such sworn statement, pay, or cause to be paid, to the City Collector such sum as the total tax due is in excess of the sum of one thousand dollars ($1,000.00) paid with the issuance of the license.

The City Clerk, or any other person authorized by the Board of Aldermen, shall have free access at all reasonable times to the books and records of any person carrying on the business described in this Chapter, for the purpose of verifying the correctness and accuracy of the statements required to be made by this Chapter.
