As used in this article, the following terms shall have the meanings indicated unless a different meaning clearly appears from the context:
CAT
A feline normally or ordinarily kept as a domesticated household pet, kept in or permitted to be at large within the dwelling of its owner or custodian.
DOMESTICATED HOUSEHOLD ANIMAL
Any animal normally or ordinarily domesticated or raised in this area and climate normally or ordinarily kept as a household pet and permitted to be at large within the dwelling of its owner or custodian.
OWNER
Any person having a right of property in any cat or other domesticated household animal or having custody of any cat or domesticated animal or any person who harbors or permits a cat or domesticated animal to remain on or around his or her property.
STRAY CAT
A cat having no known owner or custodian or known place of care and shelter and not identified with the owner's name and address on the collar of a cat, or unattended or running loose upon any public highway, street, alley, park or any public land or upon property of another person other than the owner or the custodian.
It shall be unlawful for any owner or custodian of any cat or domesticated animal to run at large or to stray beyond the limits or premises of its owner or custodian to cause any damage to any buildings, lawns, shrubbery, flower beds or any other real or personal property or to cause any annoyance to persons within the Borough of Collingdale or to tie or fasten any such cat or domesticated animal in any public place or street within the Borough of Collingdale for any purpose.
It shall be the duty of the owner or custodian of any such cat or domesticated animal within the Borough of Collingdale to keep such animal:
A. 
Confined within an enclosure from which it cannot escape; or
B. 
Firmly secured by means of a collar and chain or other device so that it cannot stray beyond the premises on which it is secured; and
C. 
On a leash or other device, the limits of which shall not be greater then six feet, so as to keep the cat or domesticated animal under the reasonable control of the person handling said animal.
Any police officer, animal control officer or health officer may seize any cat or other domesticated animal found at large within the Borough of Collingdale. Such animals are to be impounded in a licensed kennel.
A. 
The first two times a cat or domesticated animal is seized, the owner shall pay a fine of $25 to the Borough as well as reasonable fees for keeping the animal in a licensed kennel.
B. 
Any person allowing a cat or domesticated animal to run at large a third time in violation of this article shall, upon conviction thereof, be sentenced to pay a fine of not more then $300 and/or imprisonment for a term not to exceed 90 days.
