A certain
document, three (3) copies of which are on file in the office of the
City Clerk of the City of Willow Springs, being marked and designated
as the International Residential Code, 2006 edition,
including Appendix Chapters A, B, C, D, E, G, H, I and J, as published
by the International Code Council, be and is hereby adopted as the
Residential Code of the City of Willow Springs, in the State of Missouri,
for regulating and governing the construction, alteration, movement,
enlargement, replacement, repair, equipment, location, removal and
demolition of detached one- and two-family dwellings and multiple
single-family dwellings (townhouses) not more than three (3) stories
in height with separate means of egress as herein provided; providing
for the issuance of permits and collection of fees therefore; and
each and all of the regulations, provisions, penalties, conditions
and terms of such Residential Code on file in the office of the City of Willow Springs are hereby referred to, adopted and made a part hereof as if fully set out in this Chapter, with the additions, insertions, deletions and changes, if any, prescribed in Subsection (B) of this Section.

following Sections of the International Residential Code are hereby
revised:

Penalties. Any person, firm or business entity convicted
of violation of any provision of this Article or the International
Residential Code adopted herein is guilty of an ordinance violation
and shall be punishable by a fine not to exceed five hundred dollars
($500.00) or by confinement in the County Jail for a term not exceeding
ninety (90) days, or by both such fine and confinement.

Saving Clause. Nothing in this Article, or in the International
Residential Code hereby adopted, shall be construed to affect any
suit or proceeding impending in any court, or any rights acquired,
or liability incurred, or any cause or causes of action acquired or
existing, under any act or ordinance of the City of Willow Springs;
nor shall any just or legal right or remedy of any character be lost,
impaired or affected by this Article.

Liability. Nothing in this Article, or in the International
Residential Code hereby adopted, shall be construed to relieve from
responsibility or to lessen the responsibility of any person, firm,
corporation owning, controlling or constructing buildings, nor shall
the City be held as assuming any liability of any nature by reasons
of the inspecting authority hereby issued to the City Building Inspector
for inspection of buildings.
