For the purpose of this Part, the following terms shall be construed
to have the meanings set forth herein, except in those instances where
the text herein clearly indicates otherwise.
A dog, cat or any other animal, domesticated or nondomesticated.
Any animal creating, threatening or risking compromising
the integrity of the overall quality of life by way of noise, odor
or any other manner of aesthetic befouling, defiling or corruption.
Any person having the right of property in any animal or
having control of or custody of any animal, or any person who harbors
or permits an animal to remain on or around his or her property.

Cats Running at Large. No person owning or having charge, care, custody or control of any cat shall cause, permit or allow the same to run at large or to be upon any highway, street, lane, alley, court, park or other public place, or upon any private property or premises other than those of the person owning or having charge, care, custody or control of such cat, within the Borough, unless such cat is restrained by a leash and is in the charge, care, custody or control of a person with the ability to restrain it. Any cat which is in violation of the provisions of this Part shall be subject to being impounded and shall be held, cared for, released or disposed of in a manner provided under § 2-103 of this Part.

Dogs Running at Large. No person owning or having charge, care, custody or control of any dog shall cause, permit or allow the same to run at large or to be upon any highway, street, lane, alley, court, park or other public place, or upon any private property or premises other than those of the person owning, or having charge, care, custody or control of such dog, within the Borough, unless such dog is restrained by a substantial chain or leash and is in the charge, care, custody or control of a person with the ability to restrain it. Any dog which is in violation of the provisions of this Part shall be subject to being impounded and shall be held, cared for, released or disposed of in a manner provided under § 2-103 of this Part.

Terms. Any animal which is in violation of the provisions of this
Part shall be subject to being impounded and any animal which is so
impounded shall be held by the Humane Society of the Harrisburg Area,
Inc. and shall be cared for, released or disposed of as provided by
the rules and regulations for the operation of said animal shelter.

Notification of Owner. Should an animal come into the custody of
the animal shelter with attached valid identification stating the
owner's correct name and address, then the Police Department
shall, within a reasonable time from the time of impounding, notify
said owner of the fact that said animal is in the custody of the shelter.

No person, firm or corporation shall keep any pig or hog at
any place within the Borough of Mechanicsburg, nor shall any person,
firm or corporation maintain any pig pen or hog pen at any place therein.

No person shall allow any animal confined on that person's
premises to make any loud or harsh noise or disturbance that interferes
with or deprives the peace, quiet, rest or sleep of any person within
the Borough.

No person shall allow any animal owned by such person or under
such person's control to defile, befoul, corrupt or otherwise
desecrate any sidewalk, walkway, street, alley, public property or
the property of another or destroy or damage the property of another.

Any person who shall violate any of the provisions of this Part
shall, upon conviction thereof, be sentenced to pay a fine of not
less than $250 nor more than $600 and all costs of prosecution for
each and every offense and, in the default of payment of such fine
and costs, to imprisonment for not more than 30 days. Each day's
violation of any of the provisions of this Part shall constitute a
separate offense.
