All work of the City performed by paid employees shall be assigned
to and under the jurisdiction of an administrative unit. The Home
Rule Charter grants the City Council the authority to establish specific
administrative units by ordinance to perform the functions and services
provided by the City. Further, the Home Rule Charter authorizes the
City Manager to administer all functions and services provided by
the City, and thus all administrative units created in this chapter
are under the authority and control of the City Manager. It is the
declared purpose of this chapter to establish administrative units
of the City of Clairton as authorized in Article IX of the Home Rule
Charter.
Administrative units shall be created by the City Council by
ordinance. All administrative units shall be under the control and
direction of the City Manager. No administrative unit shall be created,
abolished or combined with another administrative unit until the City
Council has requested the recommendations of the City Manager, in
writing, with regard thereto and has considered any such recommendation
by the City Manager.
At the head of each administrative unit there shall be a director
or department head, who shall be appointed and who may be removed
by the City Manager. All department heads shall be appointed by the
City Manager with the advice of the City Council and shall serve at
the City Manager's pleasure. Department heads shall be chosen
solely on the basis of executive, administrative and technical qualifications
as are pertinent to the function, duties and operations of their respective
departments and as are prescribed by law. Two or more departments
may be headed by the same individual, and the City Manager may head
one or more departments.
Department heads shall have supervision and control over their
respective departments. The City Manager shall have the power to define
and assign the duties and responsibilities within any department and
may establish divisions therein and assign such divisions their work
and functions. Department heads shall:
A.
Direct
personally and through subordinates the performance of all functions,
duties and operations assigned to and required of the department and
its subordinate units by law, the charter or ordinance and such other
activities as may be required by the City Manager.
B.
Develop
and prescribe the internal organization of the department and its
subordinate units, subject to the approval of the City Manager.
C.
Assign
duties and responsibilities to subordinate employees within the department
and modify those assignments consistent with and in response to the
changing needs of service, subject to the approval of the City Manager.
D.
Develop
and prescribe, in written form, an administrative manual for the department,
subject to the approval of the City Manager.
E.
Prepare
and submit departmental budget requests in accordance with schedules,
forms and policies as prescribed by the City Manager.
F.
Prepare
and submit reports prescribed by the City Manager.
G.
Cooperate
with and furnish to any department or unit of the City any information,
service, labor, material and equipment that may be necessary to perform
a municipal function.
H.
Be
aware of and coordinate the activities of the department with appropriate
area-wide, regional and intergovernmental programs; keep the City
Manager informed of the activities and policies of such programs as
they affect the department or City; and make analyses and recommendations
regarding such activities and policies when appropriate.
I.
Administer
and evaluate intergovernmental programs, contracts and agreements
as these relate to departmental functions.
J.
Develop
and maintain internal administrative and budgetary controls, as well
as productivity and performance standards, to assure maximum levels
of quality and quantity of service within budgetary limitations.
K.
Keep
informed of developments in administrative policies, management techniques
and technological advances and make recommendations to the City Manager
concerning councilmanic or administrative regulations for the utilization
of those policies, techniques and technologies deemed to be in the
best interests of the department and the City.
L.
Keep
informed of all laws and ordinances and regulations relating to the
functions of the department.
M.
Serve
as a member of any committee or provide staff services to any authority,
board or commission to which the department head may be assigned by
the City Manager.
N.
Develop
personnel planning and employee development policies for the department,
including the planning and implementation of appropriate training
and education programs.
O.
Develop
and recommend to the City Manager rate structures for those services
for which user fees can feasibly be charged.
A.
Function.
The Department of Engineering shall be responsible for the development,
design and construction of municipal projects, including streets,
sewers, traffic control improvements, bridges and other public works
projects.
B.
Department
head. The Department of Engineering shall be headed by a City Engineer,
who shall be responsible to the City Manager for the performance of
the function of the Department. The City Engineer shall be appointed
by the City Manager with the advice and consent of the City Council
and shall serve at the City Manager's pleasure.
C.
Powers
and duties. The City Engineer shall have charge of designing and/or
coordinating the construction and maintenance of all City public works
projects, and, to that end, the City Engineer shall have the authority
and shall be required to:
(1)
Provide engineering services to the City, including the preparation
of designs, plans, specifications and estimates, as well as construction
inspection services.
(2)
Maintain Official Maps, deed records, plans and engineering records.
(3)
Coordinate with consulting engineers, architects and surveyors hired
by the City.
(4)
Provide technical consulting services to the City Manager and City
Council.
(5)
Be responsible for all elements of traffic safety, including but
not limited to the provision of traffic signals and other traffic
control devices, streetlighting, street signs, pavement maintenance and parking regulations.
(6)
Coordinate and liaison with public agencies and private companies
on construction and maintenance projects being performed in the City.
(7)
Develop a system of identifying public works projects which need
to be constructed or maintained; prioritize the projects on the list
by need and cost; and submit recommendations to the City Manager concerning
a capital improvement program.
(8)
Perform other assignments, research and study as directed by the
City Manager.
A.
Function.
The Department of Finance shall be responsible for the administration
of activities pertaining to the receipt, expenditure, accounting,
investment, custody and control of municipal funds and assets, except
to the extent that such activities are expressly charged by law, the
charter or ordinance to any other City unit.
B.
Department
head. The Department of Finance shall be headed by a Director, who
shall be responsible to the City Manager for the performance of the
function of the Department. The Director shall be appointed by the
City Manager with the advice and consent of the City Council and shall
serve at the City Manager's pleasure.
C.
Powers
and duties. The Director of Finance shall have charge of the administration
of the financial affairs of the City, and, to that end, the Director
shall have authority and shall be required to:
(1)
Compile the estimates of revenues and expenditures for the budget
and generally provide assistance to the City Manager in the development
of operating budgets, capital budgets, long-term fiscal programs,
compensation programs and related budgetary and fiscal analyses.
(2)
Supervise and be responsible for the disbursement of all moneys and
have control over all expenditures and ensure that budget appropriations
are not exceeded.
(3)
Maintain a general accounting system for the City government and
each of its offices and departments; keep books for and exercise budgetary
control over each office and department; keep separate accounts for
the items of appropriations, the amounts paid therefrom, the unpaid
obligations against it and the unencumbered balance; and require reports
of receipts and disbursements from each receiving and spending office
or department of the City government, to be made at intervals as the
Director may deem expedient.

(4)
Maintain a system of classifying revenue and expenditure accounts
that conforms, as nearly as local conditions will permit, to the uniform
classifications as promulgated by the Commonwealth of Pennsylvania,
the Government Finance Officers Association or some other nationally
accepted classification.
(5)
Submit to the City Manager a monthly statement of all receipts and
disbursements, as well as a statement of fund balances for each existing
fund in sufficient detail to show the exact financial condition of
the City.
(6)
Prepare and submit to the City Manager, as of the end of each fiscal
year, a complete financial statement.
(7)
Certify to the City Manager that all taxes, fees and other revenues
of the City or for whose collection the City is responsible not collected
by the Financial Officer have been properly collected, accounted for
and deposited into the proper City accounts.
(8)
Supervise and be responsible for all moneys receivable by the City
from the commonwealth or federal government.
(9)
Have custody of all investments and invested funds of the City or
in possession of the City in a fiduciary capacity and have the safekeeping
of all bonds and notes of the City and the receipt and delivery of
municipal bonds and notes for transfer, registration or exchange.
(10)
Review all proposed expenditures and certify to the City Manager
that no payment is made or obligation incurred against any appropriation
except in accordance with the designated budget appropriations and,
further, certify that there is sufficient unencumbered balance in
the appropriate budget appropriation to meet any proposed obligation
when it becomes due or payable.
(11)
Administer the purchasing system, supervising and being responsible
for the purchase, storage and distribution of all supplies, materials,
equipment and other articles used by any office or department of the
City government.
(12)
Supervise and be responsible for the operation and maintenance of
the City's data processing system.
(13)
Review departmental budget requests and monitor compliance with the
adopted budget throughout the fiscal year, keeping the City Manager
informed on the progress and developments of plans, policies and programs
related to the budget.
(14)
Perform other assignments related to the financial affairs of the
City as directed by the City Manager.
A.
Function.
The Department of Fire shall be responsible for the protection of
persons and property within the City against fire and for the enforcement
of applicable laws, ordinances, codes and regulations.
B.
Department
head. The Department of Fire shall be headed by a Chief, who shall
be responsible to the City Manager for the performance of the function
of this Department. The Chief shall be appointed by the City Manager
with the advice and consent of the City Council and shall serve at
the City Manager's pleasure.
C.
Powers
and duties. The Fire Chief shall have charge of supervising and directing
all functions and operations of the City Fire Department, and, to
that end, the Chief shall have the authority and shall be required
to:
(1)
Prevent and extinguish fires by exercising supervisory control over
subordinate officers to whom he or she issues orders and delegates
assigned firefighting tasks.
(2)
Plan, organize, assign and direct departmental operations with respect
to equipment, apparatus, personnel and training.
(3)
Enforce the fire prevention ordinances and regulations of the City,
such as safety regulations for public assemblies, the handling and
storage of combustible materials, the use of flammable liquids and
explosives and all other laws relating to fires and fire hazards.
(4)
Prepare and analyze records and reports related to fires and fire
hazards to ensure efficient operations, to meet service demands and
to comply with requests for information from the City Manager.
(5)
Be responsible for the day-to-day operation and maintenance of the
fire station, fire vehicles, equipment and apparatus.
(6)
Respond to general and major fire alarms and personally direct the
firefighting activities on the scene.
(7)
Establish and maintain effective working relationships with other
area Fire Departments and emergency medical service providers.
(8)
Initiate and administer a fire prevention program for the City, including
public education programs.
(9)
Serve as a liaison between the City Manager and/or the Public Safety
Director and the Volunteer Fire Department.
(10)
Coordinate Volunteer Fire Department operations and activities.
(11)
Serve in the capacity of Ordinance Officer, enforcing all ordinances
of the City as directed by the City Manager and/or the Public Safety
Director.
(12)
Work with the Public Safety Director to prepare and monitor the Department
budget.
(13)
Perform other assignments, research and study as directed by City
Manager.
A.
Function.
The Department of Public Safety shall be responsible for the protection
of persons and property within the City, including the provision of
police services, and for the enforcement of applicable laws, ordinances,
codes and regulations.

B.
Department
head. The Department of Public Safety shall be headed by a Director,
who shall be responsible to the City Manager for the performance of
the function of the Department and shall serve as the Police Administrator
in accordance with the provisions of Article XV of the Home Rule Charter.
The Director shall be appointed by the City Manager with the advice
and consent of the City Council and shall serve at the City Manager's
pleasure.

C.
Powers
and duties. The Director of Public Safety shall have charge of directing
and coordinating the delivery of public safety services within the
City, and, to that end, the Director shall have the authority and
shall be required to:
(1)
Coordinate the provisions of public safety services, evaluate the
quality of services being provided and recommend to the City Manager
changes that will improve the effectiveness and efficiency of public
safety services.
(2)
Plan the integration of public safety services; identify duplications
or underlaps of service; and assist service providers in coordinating
the delivery of services with each other.
(3)
Supervise parking operations and meter enforcement programs.
(4)
Develop and conduct community relations and education programs.
(5)
Serve as liaison with service providers, community groups, news media,
school officials and the general public on matters relating to public
safety.
(6)
Maintain necessary records and files of activities; and prepare and
monitor department budget.
(7)
Supervise and coordinate the recruitment of citizen volunteers.
(8)
Serve in the capacity of Emergency Management Coordinator for the
City of Clairton.
(9)
Develop and submit monthly reports outlining the progress and developments
of Department programs, including statistical analyses of criminal
activities taking place within the City.
(10)
Perform other assignments, research and study as directed by the
City Manager.
A.
Function.
The Department of Public Works shall be responsible for the operation
and maintenance of those physical structures that are owned and maintained
by the City to house governmental functions and to provide waste disposal,
recreation, transportation and similar operations and services.
B.
Department
head. The Department of Public Works shall be headed by a Director,
who shall be responsible to the City Manager for the performance of
the function of the Department. The Director shall be appointed by
the City Manager with the advice and consent of the City Council and
shall serve at the City Manager's pleasure.
C.
Powers
and duties. The Director of Public Works shall have charge of supervising
and directing the maintenance of the City public works operations,
and, to that end, the Director shall have the authority and shall
be required to:
(1)
Supervise, direct, plan and coordinate all personnel within the Public
Works Department, including the monitoring of work orders to make
sure that all assigned tasks are being completed in a timely manner
and that employees are following instructions and working safely.
(2)
Be responsible for directing all public works operations, including
such activities as street and storm drain maintenance, maintenance
of City-owned buildings, snow removal, vehicle maintenance, collection
and disposal of recyclables, sanitary sewer maintenance, parks and
right-of-way maintenance and parking meter maintenance.
(3)
Direct the preparation of the budget for the Department and make
procedural and operational recommendations to the City Manager.
(4)
Prepare reports, estimates and long-range public works plans.
(5)
Plan and implement a curbside recyclables collection system, including
the direction of activities such as equipment purchase, development
of a recycling ordinance, public education, coordination with public
agencies and nonprofit organizations, liaison with commercial and
industrial entities to ensure compliance with the adopted recycling
ordinance, enforcement, development of incentive programs and other
related matters.
(6)
Develop municipal service performance goals for various public works
activities in order to ensure that services are efficient and effective
and that citizen public works complaints are being answered.
(7)
Promote the efficient delivery of public works services through intergovernmental
cooperation efforts and the obtaining of grants.
(8)
Complete public works maintenance activities as requested by the
City Manager and/or the City Engineer.
(9)
Supervise custodial services provided for municipal buildings.
(10)
Perform other assignments, research and study as directed by the
City Manager.
