The City, in accordance with the provisions of 65 P.S. § 201
et seq., as amended, is hereby authorized to submit for approval by
the state agency a plan or agreement for extending the benefits of
Title II of the Social Security Act, in conformity with applicable
provisions of such act, to the employees and officers, as defined
in 65 P.S. § 201 et seq., as amended, of the City. Such
plan shall conform to the agreement entered into by the state agency,
with the approval of the Governor, and the federal security administrator
and shall conform to such requirements as are provided in regulations
of the state agency and shall incorporate the provisions of 65 P.S.
§ 201 et seq., as amended. It shall be effective with respect
to services in employment performed on and after the first day of
January 1951 or such later date as may be specified in the agreement
entered into between the state agency and the Federal Security Administration.
Upon the approval of such plan by the state agency and in accordance
with the regulations prescribed by such agency, contributions in respect
to wages of employees and officers of the City, in the amounts and
at the rates specified in the applicable agreement entered into by
the state agency, shall be paid by the City into the Contribution
Fund set up by 65 P.S. § 201 et seq., as amended, and the
City Clerk shall be authorized to make deductions by way of contributions
from the wages of the employees and officers to whom coverage has
been extended, in the amounts and at the rates specified by the state
agency, but in no circumstances to exceed the per centum set forth
in 65 P.S. § 201 et seq., as amended. Such deductions, when
collected, shall be paid into the Contribution Fund in partial discharge
of the liability of the City to such Contribution Fund. In the event
that any employee fails to pay a contribution due from him or her,
in the amount and at the rate specified by the state agency, such
payment shall be delinquent and shall bear interest at the rate of
6% per annum.
The Mayor and the City Manager are hereby delegated and authorized
to act in and for the City in the preparation, submission and execution
of any plan, agreement or agreements necessary for the purpose of
carrying out the provisions of this article and to provide for the
coverage of employees and officers of the City with old-age and survivor
insurance protection as provided for in Title II of the Federal Social
Security Act, as amended.
A sum in the amount prescribed by regulations of the state agency
is hereby appropriated from the proper funds of the City for the purpose
of paying the same to the Contribution Fund in accordance with the
applicable agreement entered into by the state agency under 65 P.S.
§ 201 et seq., as amended.
