The City of Clairton is empowered to employ professional police
officers and other employees, the selection of whom is a matter governed
by certain civil service provisions of the Third Class City Code.[1] Similarly, other areas of personnel management relating
to such employees are also controlled by civil service provisions
of the Third Class City Code (for example, this is true of certain
promotions, furloughs, reductions in force, removals, discipline,
etc.). See the Home Rule Charter and Option Plans Law of 1972, 53
P.S. § 1-302.[2] Accordingly, the City adopts the appropriate language
of the Third Class City Code as part of this chapter as though it
were fully stated herein. The incorporation of the relevant civil
service language into this chapter also incorporates the case law
interpreting that civil service language into the chapter. Candidates
for such positions who, pursuant to Third Class City Code civil service
procedures, are tentatively offered employment shall have that tentative
offer of employment finalized following the application of any required
medical exam, psychological exam or physical performance or other
testing. In terms of personnel management, including the management
of civil service employees, it is the intent of the City that it retain
the greatest possible latitude and authority permitted under the statutes
of the commonwealth, including statutes relating to collective bargaining,
home rule and others.
Unless otherwise expressly stated, the following words and phrases,
wherever used in these rules and regulations, shall be construed to
have the meanings indicated herein:
Any individual who applies in writing to the Personnel Board
for civil service positions or to the City Manager for career service
positions in response to legally advertised notice of vacancy and/or
examination.
The Personnel Board of the City of Clairton.
Employees of the City of Clairton in the career service as
that term is defined in Section 1608 of the Home Rule Charter, except
for civil service employees.
The submission to the appointing authority of names taken
from the eligible list developed by the Personnel Board.
The Chairperson of the Personnel Board of the City of Clairton,
Pennsylvania.
The City Manager of the City of Clairton.
Employees of the City of Clairton subject to the civil service
laws of the Commonwealth of Pennsylvania applicable to third class
cities, including employees of the Departments of Public Safety, Engineering,
Fire and Health.
The Council of the City of Clairton.
A person whose name is recorded on a current eligible list
or furlough list.
The list of names of persons who have passed all examinations
for a particular position.
The series of tests given to candidates to determine their
qualifications for a civil service position.
The list containing the names of persons temporarily laid
off from positions in a department of the City because of a reduction
in the number of employees.
For purposes of these rules and regulations, an entry level
sworn position in the Department of Public Safety.
An employee who has been appointed from an eligible list
but who has not yet completed his or her work-test period.
A change to a different position or rank which results in
a decrease in salary; provided, however, that a decrease in salary
without a change to a different position or rank shall not necessarily
constitute a "reduction in rank."
The permanent separation of an employee from employment in
a department of the City.
The Secretary of the Personnel Board of the City of Clairton,
Pennsylvania.
The temporary separation of an employee from employment in
a department of the City.
