There is hereby created a Special Commission on the Provision of Public Services.
The Special Commission on the Provision of Public Services shall consist of 10 members. One member shall be the Plan Coordinator, who shall serve as Chair. The other nine members are to be Council appointees. These appointees shall be City residents, and their numbers shall reflect the socioeconomic characteristics of the City's population. No more than three members may be members of the City Council and no member shall be a City employee.
A. 
The Special Commission on the Provision of Public Services shall:
(1) 
Identify various service delivery modes and the costs and benefits associated with each mode.
(2) 
Investigate various ways to finance delivery systems, aside from the use of locally generated revenues.
(3) 
Develop legislation designed to address the issue of service delivery modes in economically distressed jurisdictions.
(4) 
Recommend to the City Council a specific course of action.
B. 
The Special Commission shall assume the following responsibilities once the City Council has acted upon the Commission's course of action:
(1) 
Initiate negotiations with the legislative leadership in the Pennsylvania General Assembly relative to the adoption of the Commission's legislative package.
(2) 
Initiate negotiations with officials in other governments and other institutions which might, and can, function as service providers.
C. 
The Special Commission may employ such consultants as it deems appropriate, subject to the Council's approval.
D. 
The Special Commission shall hold one public hearing during the development of the required action plan. Other hearings may be held, as the Commission deems appropriate.
The City Manager and City Attorney shall serve the Special Commission in a staff capacity, as authorized by the Council.
A. 
The Special Commission shall make its recommendations to the Council within nine months after the members have been appointed.
B. 
The Council shall adopt a course of action within 30 days after the Commission has submitted its report.
C. 
Prior to the above action, the Council shall hold at least one public hearing 15 days before adopting a course of action. Additional public hearings may be held, as the Council deems appropriate.
The Special Commission on the Provision of Public Services may be terminated when it has completed its duties as set forth in § 91-3A and B. The Council shall determine when the Commission has fulfilled its responsibilities.
