No person shall buy, sell, deal, exercise or carry on the trade
or business of buying, selling and dealing in junk, rope, scrap iron,
lead, brass, copper and other metals and rags, bones and other materials
commonly termed as junk within the City limits without first having
obtained a license from the City Manager or the City Manager's
designee, for which license such person shall pay to the City the
sum of $100 and which shall be renewed annually on the first day of
January of each year.
The City Manager or the City Manager's designee shall give
and grant licenses to all reputable persons who may apply for the
same to buy, sell or deal and to use, exercise and carry on the trade
or business of buying, selling and dealing in junk, rope, scrap iron,
brass, copper or other metals and rags, bones and other materials
commonly termed as junk, which license shall state the exact location
of the house or premises in which such business is carried on.
No person licensed as provided in this chapter shall by virtue
of one license keep more than one place of business for the purpose
of buying, selling or dealing in any of the articles or materials
mentioned in this chapter, nor shall be or she at any time buy, sell
or deal in such articles or goods in a place other than that for which
his or her license is granted.
No person doing business under a license granted under the provisions
of this chapter shall receive or buy from minors or irresponsible
persons any scrap iron, brass, lead, copper or other metals or rags,
bones and other materials commonly termed as "junk."
The premises of all persons licensed under the provisions of
this chapter shall be accessible at all times to the authorized representatives
of the Police Department of the City for the purposes of examining
and inquiring into and searching for any articles or materials which
may be received or purchased under the provisions of this chapter.
All persons licensed under the provisions of this chapter shall
keep and retain on their premises such scrap iron, brass, lead, copper
or other metals and rags, bones and other materials commonly termed
as junk, in their original forms, shapes and conditions, for a minimum
period of 48 hours and shall not dispose of, reduce, change or alter
such original forms, shapes or conditions until such minimum period
of 48 hours shall have passed.
No person collecting or buying old rags, paper, rope, bottles
or junk of any kind shall keep or store the same in any room or cellar
or any building, or in any part thereof, which is used as a dwelling;
nor shall the same be exposed in any yard without a suitable cover,
unless approved by the City Council or the Health Officer.

Any and all persons violating any of the provisions of this
chapter shall, upon conviction thereof before a District Justice,
be subject to a fine not exceeding $600, plus costs of prosecution
and, in default of payment of such fine and costs, to imprisonment
for a period not exceeding 90 days. In addition, upon any such conviction,
any license granted by virtue of this chapter shall be forfeited.
