No person shall advertise, conduct, carry on or permit any garage,
patio, yard, tailgate or rummage sale on the grounds of or within
any dwelling within the City more than four (4) times in any one (1)
year, nor less than thirty (30) days before or after any such sale
on the grounds of or within such dwelling; however, this Section shall
not apply to any person conducting any such sale under and pursuant
to a valid merchant's license issued by the City or to any sale
by the executor, administrator or guardian of an estate; provided,
further, that all items for sale in or used exclusively for the rummage
sale shall be removed from sight at the conclusion of the rummage
sale.

Before any person shall have any such sale as described in this
Article other than those to which this Article does not apply, he/she
shall apply for and be issued a permit by the Clerk of the City of
Duquesne.

The Clerk of the City of Duquesne shall issue a permit required
by this Article to the applicant, and the fee for the permit shall
be an amount of one dollar ($1.00) per day.

No sale for which a permit is required by this Article shall
be held or scheduled for more than three (3) calendar days.

Each permit issued under the provisions of this Article shall
set forth the name of the person holding or conducting the sale, the
location of the sale and the date such sale is to be held.

Schools, churches and non-profit organizations may carry on
rummage sales of miscellaneous items for the benefit of the organization
only, with no restriction on the number of days when the sale is conducted
on school, church or commercial property.

Notwithstanding the foregoing, the Clerk may deny a permit to
any person who has conducted a rummage sale within the City of Duquesne
in violation of the terms of a permit issued pursuant to this Article
within twelve (12) months of the time application for a new permit
is made.

Notwithstanding the provisions of this Article, on the first Saturday in May and on the first Saturday in October of each year, any person may conduct a one-day rummage sale within the City without a permit. Moreover, conducting a one-day rummage sale on said Saturdays shall not be counted as one (1) of the four (4) allowable sales per year described in Section 610.170 of this Code.

All signs advertising a rummage sale must have the address and
date of the sale legibly printed upon the sign, and rummage sale signs
may be displayed no more than twenty-four (24) hours prior to the
beginning of the rummage sale and no more than twenty four (24) hours
following the end of the rummage sale.

Any person violating any of the provisions of this Chapter shall
upon conviction be punished by a fine of not more than five hundred
dollars ($500.00) or by imprisonment for a term not exceeding ninety
(90) days, or by both such fine and imprisonment.
