An appeal to the Planning Board, in lieu of to the Zoning Board of Adjustment, may be taken by an interested party affected by any decision of the administrative officer of the municipality based on or made in enforcement of the Zoning Ordinance[1] or Official Map. Such appeal shall be taken within 65 days by filing a notice of appeal in the manner set forth in Article III, § 162-22A of this Part 1 and in accordance with the provisions of Article 9 of the Municipal Land Use Law of 1975.

An appeal from any decision of the Planning Board acting as the Zoning Board of Adjustment granting a use variance pursuant to the provisions of N.J.S.A. 40:55D-70d may be taken to the Mayor and Council, provided that such appeal shall be made within 10 days of the date of the publication of such final decision of the Planning Board.
