Any entity granted a permit to excavate, repair, repave, or otherwise alter streets and sidewalks within the City ("permittee") shall have the following duties:
A. 
To backfill and restore the surface of all streets, broken into or damaged as a result of the excavation work, to its original condition in accordance with the specifications of the Department of Transportation of the Commonwealth of Pennsylvania, Publication 408, latest revision, which are hereby adopted as the specifications of the City for restoration of surfaces of streets in the City;
B. 
If necessary, to place a temporary surface over openings made in paved traffic lanes, or to lay a temporary pavement of wood or other suitable material designated by the City Code Enforcement Officer over the cut or excavation to remain until such time as the repair of the original pavement may be properly made;
C. 
To permanently restore the street in strict accordance with the City specifications to restore the street to its original and proper condition, whereby the surface shall conform to the proper grade and be of the same surface covering as the part of the thoroughfare immediately adjoining the opening;
D. 
To prosecute with diligence and expedition all excavation work covered by the excavation permit, and shall promptly complete the work and restore the street to its original condition, or as near as may be, as soon as practicable and in any event not later than the date specified in the excavation permit therefor;
E. 
To notify the City Code Enforcement Officer before such opening or excavation is refilled, resurfaced, and/or repaired, and thereupon to complete such work of refilling, resurfacing, and/or repairing to the satisfaction of the City Code Enforcement Officer and in strict conformity with the City specifications; and
F. 
To comply with all other requirements of local, state, and federal laws.
This policy becomes effective as of the date of this article.
The City may also require a permittee to file a bond with the City Manager prior to beginning excavation, repairs, or resurfacing. Such bond shall guarantee that the permittee be responsible for maintaining the portion of the street or sidewalk disturbed by such alteration, and the restored surface therof, for a period of 18 months after the completion of the resurfacing thereof.
Any violation of the above provisions shall subject the offending permittee to a fine of $50 for a first offense and $100 for a second offense. Subsequent offenses may subject the permittee to a revocation of the permittee's street permit or a more serious fine, and repeated offenses may subject the permittee to more serious penalties, at the discretion of the undersigned.[1]
