All driveways to be constructed or existing driveways to be modified, to the extent that said driveways lie within Borough road rights-of-way, shall be constructed or modified in accordance with the minimum standards set forth in § 80-7, Schedule A specifications.
As used in this chapter, the following term shall have the meaning
indicated:
The paving over of a previously unpaved surface, the realignment
of a driveway with respect to location and/or grade or the installation
of any driveway drainage facility.

No driveway or field entrance may be constructed within or along an existing Borough street unless the owner first obtains a driveway permit from the Borough Engineer or Zoning Officer. The applicant shall pay the Borough an application fee as prescribed in Chapter 10, Fees, of this Code and shall further deposit with the Borough Clerk an amount to be determined by the Borough Engineer, not to exceed $1,000, which shall constitute an inspection deposit from which the Borough shall be reimbursed for the expense incurred for engineering site inspections required.
A.
Any person applying for a driveway permit shall submit one completed
application form and three copies of the proposed driveway plans to
the Borough Clerk.
B.
The plans shall provide the following information:
(1)
A plot or site plan showing the driveway for its entire length and
the abutting portion of the public road.
(2)
A profile of the driveway showing existing and proposed center-line
grades and elevations for its entire length.
(3)
A plan showing the type of storm drainage to be constructed at the
driveway entrance to the Borough road, i.e., dish-type gutter, pipe
or culvert, sizes of pipes, culverts and gutters, grades, elevations,
typical cross sections and construction details.
No building permit shall be issued by the Zoning Officer for
the construction or alteration of any structure where it appears from
the review of the application for such permit that a driveway permit
is also required, in which case the applicant shall obtain a driveway
permit, and all work required thereunder shall be completed, except
that the surface course of bituminous concrete may be completed after
issuance of the certificate of occupancy, provided that a sum sufficient
to reimburse the Borough to pay for the cost of completing the improvement
has been deposited with the Borough Clerk or has been provided for
through issuance of a performance bond satisfactory in amount to the
Borough Engineer and in form to the Borough Attorney.
The Borough Engineer shall be notified 48 hours prior to the
commencement of work so as to permit an inspection of the work.
A.
Slope. All driveways shall be constructed or altered so as to slope
from the road right-of-way line towards the edge of the existing shoulder
or traveled way in accordance with the following schedule:
(1)
For road right-of-way widths greater than 50 feet, the driveway shall
be constructed or modified so that, at the point of intersection of
the road right-of-way line and the center line of the driveway, the
finished grade of the driveway shall be no more than six inches higher
than the center-line elevation of the existing pavement or traveled
way.
(2)
For road right-of-way widths of 50 feet or less, the driveway shall
be constructed or modified so that, at the point of intersection of
the road right-of-way and the center line of the driveway, the finished
grade of the driveway shall be no more than three inches higher than
the center-line elevation of the existing pavement or traveled way.
B.
Angle with roadway. All driveways shall be constructed so as to be
perpendicular to the existing pavement or traveled way. Any curved
or angular approach of the driveway for aesthetic or topographical
reasons shall be accomplished outside the Borough road right-of-way
or a right-of-way 50 feet in width, the center line of which is the
center line of the existing right-of-way, whichever is wider.
C.
Width. All driveways shall have a minimum driving width of 10 feet
with a minimum radius of five feet on each side where the driveway
abuts the existing road pavement or traveled way and, with regard
to residential lots, shall have a maximum width of 25 feet.
D.
Erosion control. All driveways shall be constructed and maintained
at all times in such a manner as to prevent soil erosion and sediment
from accumulating in the driveway and being deposited in the public
way.
E.
Drainage interference. All driveways shall be constructed in such
a manner as not to interfere with the drainage along the existing
pavement or traveled way. Under no circumstances shall the driveway
be allowed to extend beyond the edge of the existing ditch line at
an elevation creating a hump or uneven driving surface on the pavement,
traveled way or shoulder.
F.
Gutters, pipes or culverts. The construction of a properly sized
dish-type gutter will be permitted, provided that existing drainage
patterns are not adversely affected. The installation of a suitably
sized reinforced concrete pipe or culvert will be required in the
event that the existing flow line or ditch cannot be crossed with
a shallow dish-type gutter. The size of the pipe or culvert required
shall be determined by the Borough Engineer.
G.
Construction material.
(1)
Driveways shall be constructed of the following materials:
(a)
Driveways entering unpaved roads: four inches (compacted thickness)
of one-and-one-half-inch quarry-process (blend) stone thoroughly rolled
and compacted at the specific width.
(2)
All materials shall comply with the New Jersey State Highway Specifications
for Road and Bridge Construction, 1961 Edition, and all amendments
and revisions thereto.
H.
Indemnification. All applicants shall agree, in writing, to hold
the Borough of Milford harmless from any loss, injury or damage whatsoever
arising out of the driveway construction, whether directly or indirectly
connected with the work, or from any negligence or fault of the applicant
or its agents, servants, representatives or contractors in connection
with the performance of the work covered by the plans.
I.
Sight distance
required.[2]
(1)
Exit
driveways. Any exit driveway shall be designed in profile, grading
and location to permit a minimum sight distance of 150 feet measured
in each direction along the center line of the intersecting road.
The sight distance shall be from a sight point on the center line
of the exit driveway 15 feet behind the curbline of the thoroughfare,
or, if no curbline exists, a minimum of 30 feet from the center line
of the intersecting road. A clear sight triangle shall be established
connecting the sight points described above and shall be graded and
otherwise kept free of shrubbery, fences, structures, etc., in order
to maintain clear vision between sight points.
(2)
Entrance
driveways. Any entrance driveway shall be located to permit a minimum
sight distance of 150 feet, for left-turning vehicles, from the intersections
of the driveway and roadway center lines.
(4)
Commercial
or industrial driveways. For a commercial use, the above minimum sight
distances shall be increased by 50%. For industrial uses, sight distances
shall be increased by 100%.
Any person or persons, firm or corporation violating any of
the provisions of this chapter shall, upon conviction thereof, be
subject to a fine of $75 per day for any violation of this chapter.
Each and every day that said violation continues shall constitute
a separate and specific violation.
