For the purpose of this chapter, the following terms shall have the meaning indicated:
TRAILER
Any vehicle or structure which is, was or may be mounted on wheels, having no motor power of its own, which is either so designed, constructed, reconstructed or added to by means of portable accessories or otherwise as will permit the occupancy thereof as a temporary or permanent dwelling or sleeping place for one or more persons; or used for storage or haulage of goods and materials that either has had its wheels removed or has remained in the same physical location for 30 days or more. Trailer shall also include the term "truck body."
A. 
No trailer shall be occupied or used for dwelling purposes on any street, highway or other public place within the Borough of Somerdale nor on any privately-owned lot or tract of land therein.
B. 
Under no circumstances shall any such trailer, other than a construction trailer actually used in conjunction with construction upon a construction site, be used for dwelling purposes, human habitation or occupancy of any kind or nature, nor shall the same be connected to any water main, sewer, gas, electric or other utility. Trailers used in connection with construction shall receive permission from the Construction Code Official, who shall have reasonable discretion to regulate the use, location and length of stay of any such construction trailer.
The parking, storage and/or use of commercial-type trailers or truck bodies, which shall include any truck body commonly used for the haulage of goods and materials, whether or not such trailer or truck body remains on wheels or is affixed to a foundation, is prohibited in the Borough of Somerdale, unless either (a) said trailer or truck body I installed on a permanent foundation upon the issuance of a valid building permit and zoning permit in accordance with the provisions of the Uniform Construction Code and the Borough of Somerdale Land Use Code or (b) said trailer or truck body has been duly licensed in accordance with the provisions of § 243-6 below and otherwise complies with all terms and provisions as set forth therein. This prohibition shall not apply to the temporary loading or unloading of said trailers or truck bodies on industrial or commercial sites when said units are properly licensed under the motor vehicle laws of the state of origin.
A. 
Emergency or temporary parking or stopping of a trailer is permitted on any street or highway within the Borough for not longer than one day; subject, however, to any other and further prohibitions or limitations imposed by the traffic and parking regulations for that street or highway.
Anything to the contrary notwithstanding, a trailer may be temporarily parked or stored in the open in connection with:
A. 
A public health program sponsored by the Board of Health of the Borough or other public health agency.
B. 
A program sponsored by any public board or agency of the Borough or of its Board of Education.
C. 
A carnival or other affair or function authorized by the Borough Council.
The Zoning Officer may, on application, relax the provisions of this chapter for the use of such trailers in retail commercial sales programs in an area properly zoned for said use for a reasonable length of time with the initial permit not to exceed 12 months and with one twelve-month renewal allowed, but with the total permitted time not to exceed 24 months. No such annual permit shall be issued by the Zoning Officer if the proposed use violates the provisions of any site plan approved by the Somerdale Planning Board. Any such application for a special permit or the utilization of such a trailer or truck body in a commercial sales program shall be accompanied by the annual fee as set forth in the Somerdale Fee Ordinance. In addition, in order to qualify for this special permit from the Somerdale Zoning Officer, the applicant:
A. 
Must fully identify the products or materials being stored within said trailer or truck body;
B. 
Must not store any hazardous or inflammable materials within said trailer or truck body; and
C. 
Must consent to inspections of said trailer or truck body by the appropriate Borough officials as may be necessary to avoid any safety or health problems associated with the use of said trailer or truck body.
Any trailer or truck body currently existing upon private property upon adoption of this chapter which otherwise violates the provisions of this chapter shall not be considered a violation of the provisions of this chapter until two months following the effective date of this chapter, after which time any such use shall be considered a violation. It is the intention of this section to give all property owners sufficient time to either remove any trailer or truck body or to secure a special permit for same from the Somerdale Zoning Officer pursuant to § 243-6 above before being in violation of the terms of this chapter.
A. 
For any and every violation of the provisions of this chapter, the owner, lessee, contractor or other persons interested in any lot, building or premises where said violation has been committed or shall exist shall, for each and every violation, upon conviction thereof, be subject to any combination of the following:
(1) 
A fine of not less than $100 nor more than $1,000.
(2) 
A term of imprisonment not exceeding 90 days.
(3) 
A period of community service not exceeding 90 days.
B. 
A separate offense shall be deemed to be committed on each day during or on which a violation occurs or continues.
