This article, entitled "A local law combining the functions of Town Clerk and Tax Collector in one office," will abolish the office of Tax Collector and assign the functions of that office to the Town Clerk.
This article shall be submitted for approval of the voters at a special election pursuant to Section 23 of the Municipal Home Rule Law.

This article is enacted pursuant to the authority of subparagraph (3) to paragraph (d) of Subdivision (1) of § 10 of the Municipal Home Rule Law, authorizing a Town to adopt a local law which may amend or supersede in its application to it any provision of the Town Law relating to the property, affairs or government of the Town or in relation to any of the other enumerated subject matters in such § 10, unless there is a state legislative restriction on such amendment or supersession.
Subdivision 1 of § 23 of the Town Law is hereby superseded in its application to the Town of Delaware to provide that the Deputy Town Clerk of the Town of Delaware at the time of his/her appointment(s) and throughout his/her term(s) of office need not be an elector of the Town of Delaware so long as he or she is a resident of the County of Sullivan of the State of New York.
