This article shall be known as the "Alcoholic Beverage Control
Law of the Village of Camillus."
Unless a special permit is obtained from the Village Clerk,
no person shall drink liquor, wine, beer or any other alcoholic beverage
or have in his possession any open bottle or container containing
liquor, wine, beer or any other alcoholic beverage while such person
is on any public highway, public street, public sidewalk, public parking
area or similar public place; on private property without invitation
or permission of the owner of such property; or in any area of the
Village of Camillus, Onondaga County, New York, not licensed to serve
or dispense said alcoholic beverages by the State Liquor Authority
pursuant to the Alcoholic Beverage Control Law of the State of New
York.
A.
Consumption or possession prohibited. No person shall drink liquor,
wine, beer or any other alcoholic beverage or have in his possession
any open bottle or container containing liquor, wine, beer or any
other alcoholic beverage while such person is the operator of or a
passenger in a motor vehicle on any public highway, public street,
public parking area or similar public place or on private property
without invitation or permission of the owner of such property in
the Village of Camillus.
B.
Presumptive evidence of possession. An open bottle or container in
any vehicle shall be presumptive evidence that the same is in the
possession of all the occupants thereof and in violation hereof.
The conviction of any person for the violation of any of the
provisions of this article will constitute an offense punishable by
a fine not to exceed $250 or a sentence of a maximum term of imprisonment
for a period not to exceed 15 days, or by both such fine and imprisonment.
