The legislative findings and declarations that are set forth in the New Jersey Smoke-Free Air Act at N.J.S.A. 26:3D-56 regarding the public health hazards that are caused by tobacco smoke are included and are incorporated herein by this reference thereto.
All definitions of words and terms that are set forth in the New Jersey Smoke-Free Air Act at N.J.S.A. 26:3D-57 are incorporated herein by this reference thereto.
Smoking is prohibited in the following outdoor municipally owned areas:
A. 
The entire area of Block 244, known as Bill Henfey Park or 8th Street Field.
B. 
The entire area of Blocks 109, 110, 111, and 112, known as Allen Park.
C. 
The portion of Block 76, Lot 3, known as the Oak Avenue Playground.
D. 
The portion of Block 317.03 which is directly adjacent to the easterly side of Block 411, known as the 15th Avenue Playground.
E. 
The Boardwalk and all ramps and stairs leading to the Boardwalk.

The entire area of Block 222, Lot 8, known as Margaret Mace Park.

A municipal employee having control of those outdoor municipal areas wherein smoking is prohibited by this article shall order any person smoking in violation of this article to comply with the provisions of this article. A person, after being so ordered, who smokes in violation of this article is subject to a fine of not less than $250 for the first offense, $500 for the second offense and $1,000 for each subsequent offense.
