This Policy establishes guidelines for the use of insignia, emblems and badges which identify employees, representatives, officials, and other agents of the Kent County government.
A. 
Applicability. This Policy shall apply to all employees, representatives, officials, and other agents of the Kent County government, except the duly-elected members of the Kent County Levy Court.
B. 
Definitions.
(1) 
For purposes of this Policy, the following words and phrases shall have the meanings prescribed below:
INSIGNIA, EMBLEM, AND BADGE
Any insignia, sign, emblem, patch, pin, symbol, badge, medal, or other item utilized to identify any person as an employee, representative, official, or other agent of the Kent County government.
LEVY COURT
The Kent County Levy Court, the governing body of Kent County, Delaware.
(2) 
To the extent not inconsistent herewith, all others words and phrases not defined herein shall have the meanings ordinarily accorded to such words and phrases in common usage.
C. 
Issuance of insignia, emblems, and badges.
(1) 
The following departments of the Kent County government are hereby authorized to issue insignia, emblems, or badges as may be reasonably necessary and appropriate to identify employees, representatives, officials, and other agents of said departments:
(a) 
The Kent County Sheriff, for himself or herself, and for his or her appointed deputies;
(b) 
The Kent County Department of Community Services;
(c) 
The Kent County Department of Planning Services, for its code enforcement field personnel only;
(d) 
The Kent County Department of Public Safety;
(e) 
The Kent County Department of Public Works; and
(f) 
The Kent County Board of Assessment, for its tax assessment officers and appraisers only.
(2) 
Insignia, emblems, and badges for any of the aforesaid departments may be issued only by the heads of the respective departments, at their discretion, provided that the respective department heads shall issue no more insignia, emblems, or badges than are reasonably and minimally necessary to carry out the purpose for which such insignia, emblems, and badges are issued. Insignia, emblems, and badges issued for any of the aforesaid departments shall at all times remain the property of the Kent County government, and may be revoked by the issuing department head at any time, without notice and without any cause whatsoever.
D. 
Use of insignia, emblems, and badges. No insignia, emblem, or badge issued by the Kent County government to any employee, representative, official, or other agent of the Kent County government shall be worn, displayed, or otherwise utilized by said employee, representative, official, or other agent in any manner or for any purpose other than the manner and specific purpose for which the insignia, emblem, or badge was issued, and they shall be worn, displayed or otherwise utilized by said employee, representative, official or other agent only when the employee, representative, official, or other agent is on duty and acting in his or her official capacity. Any violation of this Policy by any employee, representative, official, or other agent of the Kent County government shall be subject to disciplinary action as prescribed by the Kent County Code, as amended from time to time.
E. 
Exceptions. This Policy shall not prohibit the design, production, sale, or distribution of promotional items (such as sweatshirts, T-shirts, baseball caps, lapel pins, posters, etc.) which are designed, produced, sold, or distributed solely for the purpose of promoting the name and goodwill of the Kent County government; provided that the design, production, sale, and distribution of all such promotional items shall be subject to the review, consent, and approval of the County Administrator.
F. 
Authority. This Policy is adopted pursuant to the powers conferred upon the Levy Court of Kent County, Delaware by 9 Del. C. § 4110.
