The provisions of this chapter with respect to the meaning of
technical terms and phrases, the classification of different kinds
of types of sewers, the regulations with respect to making connections
to sewers, and other technical matters shall be interpreted and administered
by the Town.
A.
Any party aggrieved by any decision, regulation, or provision under
this chapter, as amended from time to time, shall have the right of
appeal within 20 days of said decision to the Town Council who shall
issue a decision within 20 days.
B.
If said appeal is denied by the Town Council, then said aggrieved
party shall have the right to appeal to the Superior Court of Hillsborough
County for equitable relief, provided that said appeal is entered
within 30 days from the issuance of the decision of the Town Council.
A.
The discharge standards and requirements set forth for the purpose
of preventing discharges to the wastewater collection system that
would harm the sewers, wastewater treatment process, or equipment;
would have an adverse effect on the receiving stream; or would otherwise
endanger lives, limb, public property, or constitute a nuisance.
B.
To meet these objectives, the Director may, from time to time, review
and set more stringent standards or requirements if, in the Director's
opinion, such more stringent standards or requirements are necessary.
At a minimum, this review will be performed at least once every five
years. In forming this opinion, the Director may give consideration
to such factors as the quantity of waste in relation to flows and
velocities in the sewers, materials of construction of the sewers,
the wastewater treatment process employed, capacity of the wastewater
treatment facility, degree of treatability at the wastewater treatment
facility, pollution prevention activities, and other pertinent factors.
The limitations or restrictions on materials or characteristics of
waste or wastewaters discharged to the sanitary sewer shall not be
exceeded without the approval of the Director.
C.
The Director shall allow affected users reasonable time to comply
with any changes to the local limits. The conditions and schedule
for compliance shall accompany the written notification of amended
local limits.
