A. 
Unless otherwise expressly stated, the words defined in this chapter, for the purpose of this chapter, shall have the meanings herein indicated.
B. 
Any pertinent word or term not a part of this listing but vital to the interpretation of this chapter shall be construed to have its usual legal definition.
As used in this chapter, the following terms shall have the meanings indicated:
ACCESS
The way over which traffic moves to and/or from the property abutting such street or alley, and the way over which traffic moves to and/or from a collector street to a minor street, or from a street to an alley.

ALLEY
A permanent service right-of-way which affords only a secondary means of access from such right-of-way to abutting property and is not intended for general traffic circulation.
AREA, LOT
The total area within the lot lines.
BLOCK
Property abutting on one side of a street and lying between the two nearest intersecting or intercepting streets, or between the nearest intersecting or intercepting street and railroad right-of-way, waterway, unsubdivided area or other definite boundary.
BUILDING
An enclosed structure having a roof supported by columns, walls, arches or other devices, and used for the housing, shelter or enclosure of persons, animals or chattels.

COMPREHENSIVE PLAN
The complete plan, or any of its parts, for the development of the City, and the unincorporated 1 1/2 mile area contiguous thereto, as prepared by the Plan Commission and adopted by the governing body as the official plan.

CONSTRUCTION
The excavation of earth to provide for a basement or cellar; and/or the addition to or removal from a lot or tract of land of earth or water so as to prepare said lot or tract of land for the construction of a structure; and/ or the placing of construction materials in a permanent position and fastened in a permanent manner; and/or the demolition, elimination or removal of an existing structure in connection with such construction.

DWELLING
A building designed for residential living purposes and containing one or more dwelling units and/or lodging units.
DWELLING, MULTIFAMILY
A dwelling containing three or more dwelling units.
DWELLING, SINGLE-FAMILY
A dwelling containing one dwelling unit.
DWELLING UNIT
One or more rooms constituting all or part of a dwelling which are used exclusively as living quarters for one family, and not more than two roomers or boarders, and which contain a stove, sink and other kitchen facilities.
EASEMENT
A grant by the property owner of the use of land by the public, a corporation or persons for specified purposes.
FAMILY
One or more persons living together in a single dwelling unit as a traditional family or the functional equivalent of a traditional family. It shall be a rebuttable presumption that four or more persons living together in a single dwelling unit, who are not related by blood, adoption, or marriage, do not constitute the functional equivalent of a traditional family. In determining the functional equivalent of a traditional family, the following criteria shall be present:

A. 
The group shares the entire dwelling unit.
B. 
The group lives and cooks together as a single housekeeping unit.
C. 
The group shares expenses for food, rent, utilities or other household expenses.
D. 
The group is permanent and stable, and not transient or temporary in nature.
E. 
Any other factor reasonably related to whether the group is the functional equivalent of a family.
GOVERNING BODY
The City Council.
GRADE
The ascending or descending inclination with the horizontal of a street, measured along the center line of the right-of-way, expressed by stating the vertical rise or fall as a percentage of the horizontal distance.

LONG-TERM LAND LEASE
The leasing of a portion of a tract of land for a period of time of 10 years or more for new development where sale of said tract of land would obligate the owner to comply with the subdivision code regulations of the El Paso City Code as contained in this Chapter 260.

LOT
The tract of land within a subdivision marked by the subdivider on the plat as a numbered, lettered or other identified tract of land to be offered for sale, dedication or development.

LOT, CORNER
A lot located:
A. 
At the junction of and abutting two or more intersecting streets; or
B. 
At the junction of and abutting a street and the nearest shoreline or high water line of a stormwater or floodwater runoff channel or basin; or
C. 
At the junction of and abutting two or more stormwater or floodwater runoff channels or basins; or
D. 
At the abutting point of abrupt change of a single street, where the interior angle is less than 135°, and the radius of the street center line is less than 100.
LOT, INTERIOR
A lot other than a corner lot.
LOT LINES
The lines bounding a lot.
MAJOR THOROUGHFARE PLAN
A part of the Comprehensive Plan which sets forth the general location, alignment, and dimensions, and the identification and classification of existing and proposed streets.
OWNER or OWNERSHIP
An individual, firm, association, syndicate, partnership, corporation, company, organization, trust or other legal entity having a proprietary interest in a use, structure, lot or tract of land.
PERSON
Includes a partnership, association, firm, trust, club, institution, company or corporation, as well as an individual.
PLAN COMMISSION
The municipal planning commission of the City or, if there is none, the Tri-County Regional Planning Commission of Peoria, Tazewell and Woodford Counties, Illinois.
PLANNED DEVELOPMENT
A tract of land which is developed as a unit under single ownership or control which includes two or more main or principal structures.
PLAT
A map, plan or layout showing the subdivision of land into lots.
PLAT OFFICER
The person designated by the City as administrator of this chapter.
PROPERTY
The general term denoting, either singularly or in combination, an area, lot, parcel, tract, plot or otherwise-designated portion of land.
PUBLIC WATER SYSTEM
A constructed system for the acquisition, purification and transmission of potable water to individual users and which is approved by the Illinois Environmental Protection Agency.
RIGHT-OF-WAY
The entire dedicated tract or strip of land that is to be used by the public for circulation or service.
SANITARY SEWER
A constructed conduit for the collection and carrying of liquid and solid sewage wastes, other than stormwater, to a sewage treatment plant, and which is approved by the Illinois Environmental Protection Agency.
SCHOOL
A building or group of buildings, and all associated structures, facilities and grounds, in or on which instruction is given in subjects that are fundamental and essential in general education, and which is under the supervision of the State of Illinois Superintendent of Schools.
SIDEWALK
That paved portion of the right-of-way designed and intended for the movement and use of pedestrian traffic.
STORM SEWER
A constructed conduit for the collection and carrying of surface waters to a drainage course.
STREET
A. 
A thoroughfare within the right-of-way which affords the principal means of access to abutting property. A street may be designated as an avenue, boulevard, drive, highway, expressway, lane, parkway, place, road, thoroughfare or by other appropriate names.
B. 
Streets are identified according to type of use by the Major Thoroughfare Plan, as follows:
(1) 
EXPRESSWAYA street designated on the Major Thoroughfare Plan and representing a partially access-controlled divided facility serving speeds for trip lengths generally in excess of three miles.
(2) 
COLLECTORA street designated on the Major Thoroughfare Plan and generally meant to serve secondary traffic generators, to collect and distribute traffic between expressways and minor streets.
(3) 
MINORA street primarily designed to provide access to abutting property, and to gather individual trips for delivery to a collector street.
STRUCTURE
Anything constructed or erected with a fixed location on the surface of the ground or underground, or affixed to something having a fixed location on the surface of the ground.

SUBDIVISION or SUBDIVIDE

A. 
Any division or development of any part, lot, area or tract of land by the subdivider into lots two or more in number for the purpose, whether immediate or future, of conveyance, transfer, improvement or sale;
B. 
Any dedication of streets, alleys, or easements dedicated or intended to be dedicated to public use;
C. 
Any long-term land lease for new development.
