The purpose of this ordinance is to provide an orderly procedure for the naming or re-naming of Town or any Town property or portion thereof.

The Town Council is authorized and empowered to enact an ordinance to name or rename any Town property, or a portion thereof, in honor of a person, family or group.
The Town Council may accept petitions from qualified electors of the Town proposing to name property owned by the Town of Cumberland. The Town Council may also accept resolutions in favor of naming Town property from other Town boards and commissions. This section shall not prohibit the Town Council from acting to name Town property or any portion thereof on its own initiative.

The Town Council may consider the following guidelines when naming Town property or any portion thereof. The guidelines are not exhaustive, nor are they standards or requirements. As each matter will be unique, the guidelines listed below as well as additional facts unique to the matter being addressed by the Town Council should be considered.
(1) 
How the subject property relates to the person, family or group;
(2) 
Whether public service has concluded and whether it is foreseeable that public service occur in the future, if applicable;
(3) 
Whether the person is living;
(4) 
Whether other persons, families or groups are equally deserving of the honor;
(5) 
If by petition, what number of signatures are by qualified electors of the Town.
(6) 
Whether and what type of contributions, financial or otherwise, have been made to the local community, Town, state and/or federal government; and
(7) 
Whether there are any negative factors unique to the person, family or group.

The Town Council may establish an ad hoc committee to review and report on the naming of Town property or any portion thereof.

Upon receipt of a proposed ordinance, in any form, the clerk shall cause reference to the proposed ordinance be posted on the home page of the Town's website, continuing for 60 days prior to a public hearing to consider the proposed ordinance.
The affirmative vote of five or more members of the Town Council shall be required to pass an ordinance under this division.

The Town Council shall designate a suitable location and memorial where the person, family or group may be honored.
