(a) 
Created. There is created and established the department of animal control, which shall be a division within the Town police department.
(b) 
Animal control officer and assistant. The positions of animal control officer and assistant animal control officer within the department of animal control are created. The animal control officer and assistant animal control officer shall be appointed by the Mayor with the approval of the Town Council.

No person shall interfere with, hinder or molest the animal control officer or any regular police officer in the performance of his duties or seek to release any animal in the custody of the animal control officer or any regular police officer, except as provided in this division.

(a) 
The keeping or harboring of any dog or other animal or fowl, whether licensed or not, which by habitual howling, yelping, barking or other noise disturbs or annoys any considerable number of persons or a neighborhood is unlawful and is declared to be a public nuisance, and each day shall constitute a separate offense.
(b) 
It shall be unlawful to allow or permit any animal to trespass on private or public property so as to damage or destroy any property or thing of value. Such trespass is declared to be a nuisance, and any such animal may be impounded by the animal control officer or any police officer.
(c) 
Whenever it shall be affirmed in writing by two or more persons having separate residences or by persons regularly employed in the neighborhood that any animal is an habitual nuisance because of trespassing; howling, barking or other noise; damaging property; being vicious or by its actions potentially vicious; or in any other manner causing undue annoyance, the animal control officer, if he finds such nuisance to exist, shall serve notice upon the owner or custodian that such nuisance must be abated.
(d) 
Barking dogs. No person shall keep or harbor any dog licensed or not, which by habitual howling, yelping, or barking does disturb the quiet of any person residing in the neighborhood, and each day shall constitute a separate offense.

Except as otherwise provided in this chapter, any person convicted of violating any provision of this section may be punished by the payment of a fine not exceeding $50 for the first offense, not exceeding $100 for the second offense within a year and not exceeding $200 for the third and any subsequent offense within a year, to be recovered by action of debt or by complaint and warrant. However, any person cited for any violation of this section may be issued a citation in such form as the Chief of Police shall authorize, and the payment of the fine for the violation may be paid by mail. Should the required fine not be received by the Police Department within 30 days of the date of issuance or should the person so cited return the citation indicating a not guilty plea to any such charge, a summons shall issue to the person so cited requiring an appearance in the Sixth Division Court of the State or the Town of Cumberland Municipal Court to answer the charge.

Any animal, other than a dog, found running at large within the Town limits may be impounded or disposed of according to law when such action is required either to protect the animal or to protect the residents of the Town.

Any animal other than a dog impounded under the provisions of this chapter may be reclaimed by the owner upon the payment of impoundment fees established from time to time by the Town Council and on file in the office of the Town Clerk.

(a) 
All household pets, with the exception of those that normally inhabit a totally enclosed environment, are prohibited from all structures or buildings higher than three stories used for residential purposes within the Town.
(b) 
Each violation of this section shall be punishable by a fine of $25.

No wild animal may be kept within the Town limits, except under such conditions as shall be fixed by the animal control officer. However, wild animals may be kept for exhibition purposes by circuses, zoos and educational institutions in accordance with such regulations as shall be established by the animal control officer. Any wild animal which escapes and is found at large may be destroyed by the animal control officer or any regular police officer.

Hunting, possessing or taking deer is prohibited within the boundaries of the Town.
