There shall be no game rooms in the Town.

Any person, firm, or corporation desiring to enter into any
business operation within the Town, whether to establish a new business
or by purchase or assignment from any existing business enterprise,
shall file notice of such intention with the Town Clerk and such notice
shall state therein the nature of the business to be established or
operated and give the name or names of the owners, partners, or if
a corporation, the principal officers thereof. Such notice shall be
filed with the Town Clerk at least 15 days prior to such establishment,
purchase or assignment and any person, firm or corporation failing
to file such notice shall be fined the sum of $5 per day for each
day that such notice is not filed.

(a) By virtue of the power and authority contained in the Town of Cumberland
Home Rule Charter, the Town Council of the Town of Cumberland does
hereby direct the purchasing agent of the Town, to award contracts
and purchases under $5,000, made by the Town to business establishments
doing business within the Town or to the owner of which is a Cumberland
resident, even though said business establishments shall not be the
lowest bidders, whenever the net bid or net quotation of such business
establishments, after being reduced by 1% becomes the lowest bid or
quotation; provided, however, that the provisions of this section
shall become operative only in the event that the said purchasing
agent shall have satisfied himself that said business establishments
have complied with the specifications provided and with all other
purchasing requirements. Said business or owner must submit satisfactory
evidence of said residence to the satisfaction of the purchasing agent
of the Town.
(b) Whenever a contract shall be awarded or a purchase made by virtue of the provisions of Subsection
(a) hereof, said contract or purchase shall be made at the net bid or net quotation and not at the net bid or net quotation reduced by 1%.
(c) Whenever any other municipality grants a business situated within
the Town the same preference as outlined herein then, the Town shall
extend to the businesses of that community that same preference granted
herein to businesses located in the Town. Proof of said community
granting preference to Cumberland businesses shall be satisfied by
a certified copy of a duly enacted ordinance filed with the clerk
of the Town.
