The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
PARKS and PLAYGROUNDS
Shall include all Town-owned or controlled facilities including (but not limited to) Tucker Memorial Field, Diamond Hill Park, The Monastery, Valley Falls Heritage Park, Epheta Park, Manville Landing, Mercy Woods, and the Fanning Wilderness Area.

No person shall operate a motor vehicle within park limits at speeds in excess of 15 miles per hour, unless otherwise designated.

The operator of a motor vehicle shall grant the right-of-way to all persons crossing streets, lanes or highways within the limits of park areas.

No person or vehicle shall be allowed within the limits of any public park or playground area between the hours of 9:00 p.m. and 6:00 a.m., except by special permission.

No person shall operate any motorized vehicle, including automobiles, trucks, motorcycles, mopeds, minibikes, or dirtbikes on any trail, walkway, or in any other area where motorized vehicles are prohibited. No person shall operate any type of vehicle, including bicycles, on any walking/jogging trails, except by special permission.

No person shall wash, polish, clean or repair any motor vehicle within the limits of any park or playground area.

No person shall bring into a park or play-ground area any animal, unless such animal is under control at all times on a leash of not more than six feet in length. No person shall leave an animal unattended in an automobile in any park or playground area.

Horses shall be allowed within the limits of any park or playground only upon receipt of official permission.

Sirens and other noise-making devices are not to be operated within the confines of park or playground areas. Engine-powered model air-planes, cars and boats may be operated upon the receipt of official permission only.

The consumption of food and beverage is permitted only in designated areas.

No person shall possess, drink, sell or offer for sale any intoxicating beverages within the limits of any park or playground area, except by official permission/license by Town Council.

The playing of golf or the driving of golf balls is prohibited in all park and playground areas.

Boats shall be launched or landed at designated areas of parks and playgrounds only.

No person shall bring into any park or playground area any refuse, ashes, garbage or other material for the purpose of disposal within such area.

No person shall start a fire in any park or recreation area without first obtaining a permit. Fires must be kept in designated areas only, limited to reasonable size and shall be extinguished before leaving the area. The dumping of ashes from portable picnic grills is prohibited, except into receptacles provided for this purpose.

No person shall cut, remove or damage any tree or shrub within a park area, nor shall any person deface any buildings or public property. However, the Director of Planning and the Director of Parks and Recreation, in consultation with the Tree Warden, may approve cutting or removing trees and shrubs in a park area when such vegetation is deemed to be invasive species, damaged, or dying, or may otherwise threaten the safety and/or use of the park.

No person shall hunt, trap or carry firearms within a park or playground area, except by official permit.

No person shall use profane or indecent language or in any manner annoy another person or commit any disorderly or indecent act within the limits of a park or playground area.

No person shall refuse or neglect to obey the directions of an enforcement officer or any authorized representative of the Town.

No person shall offer for sale at any park or playground area any goods or services of a commercial nature without official permission.

No person shall distribute or exhibit any printed or written matter without official permission, nor shall any person hold any public meeting, at any park or playground without official permission. When official permission is granted, the distributor or exhibitor shall be responsible for removal of all litter which may result from such distribution or exhibition.

No person shall bathe or fish in, go into or send any animal into any of the waters of any park or playground area, provided, that fishing in any such waters may be allowed by official permission.

It shall be unlawful for any person to erect any tent or to camp or live in any park or playground area without official permission.

Sledding, sliding, skiing or rock climbing is prohibited unless otherwise posted. Where any of the aforementioned activities are permitted by act of the Town Council the Town shall conspicuously mark and/or identify the area where the activity is permitted, the exact nature of the permitted activity and the hours when permitted.

Any person who commits any of the offenses enumerated in §§ 28-2 through 28-24 shall be punished by a fine of not more than $100 for each offense or by imprisonment of not more than five days or both.

(a)

VEHICLE
That in or on which a person or thing is or may be carried from one place to another, especially along the ground.
(b) 
No vehicle of any kind whatsoever shall be permitted to travel in, on or about the land of James H. Lynch Memorial Park in the Town or on any other land owned by the Town which is adjacent to or abutting such park without special permission from the Town Council. Emergency vehicles would be permitted.
(c) 
Any person violating this section shall be punished in accordance with § 1-4.

No additional structures or impervious surface shall be added to the monastery property. No additional recreational uses or expansion of existing uses shall be allowed. The conservation and management plan for the monastery, adopted by the Town Council, further identifies allowed and prohibited uses and how the property is to be maintained and managed.

The Town Council shall pass by resolution a "Field Maintenance Plan" detailing a maintenance plan for the Town's athletic fields. Said maintenance plan shall be amended by the Town Council from time to time as necessary.

The Town Solicitor is empowered to require from any user or renter of a Town-owned property, a license agreement indemnifying the Town for losses and/or damages arising out of a renter's negligence, as well as adequate insurance coverage, as he/she deems necessary to protect the Town's legal and financial interests. The Director of Parks and Recreation is empowered to issue policies and rules regarding application process, allocation of fields, and general use of Town property, not inconsistent with this chapter. Such materials shall be provided to applicant upon any request for application.
