The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
DIRECTOR
The director of the department of public works. The director may from time to time delegate certain of the duties described in this article to designees who shall act in the Town's behalf.
ENGINEERING DEPARTMENT
The Town Engineering department consisting of the Town Engineer and the construction inspector.
PERMITTEE
Any person including utility companies authorized to undertake excavation or in any way make a change to existing conditions in a public way in the Town.
PUBLIC WAY
Any accepted road, including such appurtenances as berms, curbs, drains, sidewalks and shoulders within the layout, for which the public has access and the Town is responsible for maintaining.
WORKING DAY
Monday through Friday, holidays excluded, between the hours of 7:00 a.m. and 4:00 p.m.

(a) 
Any person who performs nonemergency excavation work without a permit, as required in this article, or who continues to perform excavation work of any kind after a permit has expired shall be fined $100 per day until a permit has been applied for.
(b) 
Anyone who performs emergency work and fails to notify the director or apply for a permit within one working day following the start of the work shall be fined $100 per day until a permit has been applied for.
(c) 
Anyone who performs work without a permit on the basis that it is an emergency and subsequent documentation, as required by this article, fails to justify the emergency shall be fined $100 per day until a permit has been applied for.
