This chapter shall be known as the "Property Ownership Registration Local Law of the Village of New Hempstead."
There are many circumstances that occur that require Village authorities to communicate with the actual owner of real property situated in the Village. These occurrences may be the result of emergencies or situations requiring the enforcement of the laws of the State of New York or local laws of the Village of New Hempstead. The Board of Trustees of the Village of New Hempstead finds that a registration of the address of the actual owner of real property situated in the Village is necessary to accomplish the purpose.
A. 
All owners of real property situated in the Village of New Hempstead shall, not later than February 29, 1984, file with the Village Clerk-Treasurer of the Village of New Hempstead, on a form to be provided by the Village for that purpose, the name, address and telephone number of the actual owner of such real property. In addition, each owner of real property so situated who shall reside or, in the case of a corporation or partnership, have its principal place of business outside the territory of the Village of New Hempstead shall file with the Village Clerk-Treasurer the name, address and telephone number of an individual designated and authorized to act on behalf of the owner in matters concerning the management and operation of the property of the owner in relation to the Village of New Hempstead.
B. 
The individual designated to act on behalf of the owner, pursuant to Subsection A above, shall reside in Rockland County. This individual shall, by having been so designated, be authorized to accept service of notices and legal process on behalf of the owner and to bind the owner to any settlement, fine, judgment or other disposition, other than incarceration, which may result from any civil or criminal action or proceeding instituted by the Village of New Hempstead against such owner.
C. 
In each instance in which Subsection A above requires the designation of an individual authorized to act on behalf of an owner, such initial designation shall be filed with the Village Clerk-Treasurer not later than February 29, 1984, or within 20 days of the occurrence of any event causing such designation to be required, whichever is later. Thereafter, in each such instance a new designation shall be required to be filed with the Village Clerk-Treasurer annually, no later than January 31 of any given calendar year.
D. 
In the event of any change in ownership of any real property situated in the Village of New Hempstead, the new owner of such real property shall be required to file with the Village Clerk-Treasurer, within 20 days after such change, a new ownership registration form and, in addition, if required by the provisions of Subsection A above, a new designation of an individual authorized to act on behalf of the owner.
A. 
Any owner of real property who or which willfully shall fail to file the ownership registration form with the Village Clerk-Treasurer at the times herein required shall, upon conviction, be punished by a fine not to exceed $100.
B. 
Any owner of real property who or which is required by the provisions of § 214-3A hereinabove to file a designation of an individual authorized to act on behalf of such owner and who or which shall fail to file such designation with the Village Clerk-Treasurer at the times herein required for any reason whatsoever, whether or not such owner has any knowledge of or intends any violation of this chapter, shall, upon conviction, be punished as follows:
(1) 
For a first conviction thereof, by a fine of not less than $50 nor more than $500.
(2) 
For a second such conviction, by a fine of not less than $100 nor more than $1,000.
(3) 
For a third or subsequent such conviction, by a fine of not less than $200 nor more than $2,000.

This chapter shall be enforced by the Mayor, Deputy Mayor and Code Inspector of the Village of New Hempstead, each of whom is hereby authorized and empowered to issue an appearance ticket, returnable in the Justice Court of the Village of New Hempstead, for any violation of any provision of this chapter.

A. 
The Village Clerk-Treasurer is hereby directed to notify, by mail, each individual designated pursuant to this chapter to act on behalf of a nonresident owner of real property in the Village of New Hempstead of such designation.
B. 
The Village Clerk-Treasurer is further directed to notify, by mail, each such nonresident owner of real property and each such designated individual of the duties and powers conferred upon such designee by virtue of such designation, pursuant to this chapter.
C. 
In every instance in which a notice or legal process is served upon an individual duly designated to act on behalf of a nonresident owner of real property, pursuant to this chapter, the Village Clerk-Treasurer is hereby directed to send a copy of such notice or legal process to the nonresident owner, by certified mail, return receipt requested, directed to such nonresident owner at the address shown on the last filed ownership registration form for the property in question.
