No person or persons, partnership, firm or corporation shall move, or cause to be moved, from any place within the Borough of Tamaqua to another place therein or to a place beyond the limits thereof, or move, or cause to be moved from any place beyond the limits of the Borough of Tamaqua to a place or places within the Borough of Tamaqua any household goods in bulk, without first securing from the Borough Manager of the Borough of Tamaqua a permit for such moving or transportation.
Any person or persons, firm, or corporation desiring such a permit for the removal or transportation of household goods in the manner above-described, shall make application to the Borough Manager of the Borough of Tamaqua, setting forth his, its, or their name and address, and also setting forth names of the owners or reputed owners of the property to be moved, the address and location from which the property is to be moved, and the new address or location of the place to which the property is to be moved.
The Borough Manager of the Borough of Tamaqua shall, upon application being made, as provided in § 319-2 of this chapter, issue a permit without charge. Such application shall set forth the name of the permittee as well as the name or names of the owners of the goods to be moved and the address from which the goods are to be moved and the address to which the goods are to be delivered. No permit shall be issued to remove to a place beyond the limits of the Borough, when any taxes due the Borough, other than real estate taxes, or when any charge for services rendered by the Borough, such as water, sewer or garbage services or charges of a similar nature, remain unpaid by the owners of the goods to be moved.
The provisions of this chapter shall be enforced by the Mayor or Borough Manager or by such officer as may be designated by the Borough Council.

Any person or persons, whether principal or agent, violating any provision of this chapter, or furnishing false information to the Borough Manager or using any false name or address shall, upon being found liable therefor, pay a fine of not more than $600, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. If the penalty is not paid, the Borough shall initiate a civil action for collection in accordance with the Pennsylvania Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this chapter in equity in the Court of Common Pleas of Schuylkill County.
