This program may be cited as the "Identity Theft Prevention
Program Implementation Ordinance of 2009."
A.
The City of El Paso has developed this Identity Theft Prevention
Program ("Program") pursuant to the Federal Trade Commission's Red
Flags Rule ("Rule"), which implements Section 114 of the Fair and
Accurate Credit Transactions Act of 2003. (16 CFR 681.2)
B.
This Program was developed with oversight and approval of the City
Council. After considering the size and complexity of the City of
El Paso's operations and account systems and of the nature and scope
of the City of El Paso's activities, the City Council determined that
this Program was appropriate for the City of El Paso, and therefore
approved this Program on April 6, 2009.
This Program applies to the creation of, modification of, and
access to the identifying information of the holder of a covered account
by any and all personnel of the City of El Paso, including management
personnel. This Program does not replace or repeal any previously
existing policies or programs addressing some or all of the activities
that are the subject of this Program, but rather it is intended to
supplement any such existing policies and programs.
