A. 
No person, firm or corporation shall construct a new driveway for vehicles across any sidewalk in the City where the driveway did not previously exist without having first obtained a permit therefore.
B. 
Applications for such permits shall be made to the Zoning Officer and shall be accompanied by the fee as set forth in the fee schedule.
C. 
Permits shall not be required for replacement of driveways that previously existed, even though such driveways may have existed over a sidewalk. Although no permit shall be required from the City, all landowners replacing a driveway for vehicles across any sidewalk in the City, shall be encouraged to first obtain approval from the Director of Public Service in order to make sure the landowner is in compliance with the provisions of this chapter regarding the construction of driveways especially as they affect the sidewalks in the City of El Paso. Any violation of this chapter shall be subject to the general penalty provisions of this Code.[1]

No driveway shall be so constructed or graded as to leave a step, sharp depression or other obstruction in the sidewalk. The grade shall be as nearly as possible the same as that of the adjoining sidewalk. It is unlawful to have the surface finish of any driveway where the same crosses the sidewalk constructed of such materials as to render it slippery and hazardous to pedestrians, or to have the grade of such portion vary from the grade of the sidewalk, or be other than level.
Driveways across sidewalks shall be constructed of concrete or of such other materials as may be approved by the Council.
It shall be the duty of the person maintaining a driveway to keep the same in good repair where it crosses the sidewalk, and free from obstruction and openings.

No building permit shall be issued for newly constructed improvements in accordance with Chapter 315, Zoning, § 315-99, of the El Paso Municipal Code unless the owner agrees to construct a concrete driveway approach from the edge of the paved City street extending along the property owner's real estate through the sidewalk located along the property owner's real estate. In the event no sidewalk exists, the property owner shall construct a concrete driveway approach from the edge of the street to the lot line of the property owner.
This requirement shall apply to newly constructed improvements only and shall not affect presently existing improvements and driveway approaches extending to the same.
