Debt reduction surcharge. The collection of a debt reduction
surcharge for the purpose of recovering debt shall remain in effect
in accordance with Ordinance No. 15-12 as approved by the Town Council.
|
Collection of outstanding water and sewer bills shall result
in termination of water service to the subject property until such
time that the outstanding balances are collected and/or a lien being
placed against the subject property and may result in tax sale to
collect outstanding balances.
|
Said water bills shall be due and payable on the date stated
therein, and all water bills remaining unpaid 31 days thereafter shall
carry until collected, a penalty of 14% upon the unpaid amount and
a penalty of $5 each billing period.
|
Monetary and percentage terms may vary slightly due to round-off
effect to nearest whole dollar or nearest whole percentage point.
|
Any customer using an average of 100,000 gallons or more per
month will be billed monthly. All other customers shall be billed
at such times as determined and agreed upon by the Finance Director
and the Water Superintendent.
|
Infrastructure surcharge. Funds which are budgeted and/or collected
through the infrastructure revenue and expense lines and capital improvement
expense line of the approved annual water fund budget which are not
expended in each fiscal year shall be transferred to a restricted
water infrastructure fund for the purpose of completing infrastructure
projects within the water system. The funds shall be transferred to
the restricted water infrastructure fund within 90 days of the end
of each fiscal year, and the amount shall be recommended by the Finance
Director and Water Superintendent and approved by the Town Council,
subject to changes proposed by the annual audit.

Sign permits. The sign permit fee shall be a base fee of $10, plus
$1 per square foot in excess of 10 square feet.
(f)
Certificate of use and occupancy. The fee for a certificate of use
and occupancy for a single-family residence shall be $25 per inspection
and $50 per reinspection.
(g)
911 House Number Fee. $25.
(h)
Zoning certificates and zoning book copies. $25.
(i)
Commercial permits. Commercial permit fees shall be as follows:
(1)
Gasoline stations. The fees for the erection of gasoline station
buildings shall be the amounts specified in the schedule of permit
fees in Subsection (a) of this section, and in addition there shall
be a fee of $50 for each gas pump and a fee of $25 for each tank for
petroleum products.
(2)
Moving buildings or other structures. The fees for the moving of
buildings or other structures shall be as follows:
a.
If relocated so as not to involve the use of public highways in the
process of moving, the fee shall be $10.
b.
If not more than 2 1/2 stories in height and involving use of
public highways, the fee shall be $25.
c.
If more than 2 1/2 stories in height and involving use of public
highways, the fee shall be $50.

Demolition. The fees for the demolition of buildings or other structures
will be in accordance with the following table:

In accordance with the state building code, G.L. 1956, §§ 23-27.3-113.1
and 23-27.3-118.0 when a permit is required, failure to comply with
this provision shall include the following:
|
a.
Late filing fee. If an owner or agent files an application for the
required permit after work has commenced or has commenced work prior
to the issuance of the required permit, a late filing fee shall be
added to the normal fee that would otherwise apply. The late filing
fee shall be double the normal fee.
b.
Failed inspection fee. For a failed inspection, a fee of $25 shall
apply for the necessary reinspection of the corrected work.
(j)
In addition
to the fees for permits issued under this section, any permit issued
electronically through ViewPoint shall be charged a $5 technology
fee.

Assessment charges for such sewers shall be computed at the
rate of $79 per linear foot of lot frontage payable over a period
of 20 years. The method used to calculate the sewer assessment is
as follows:
Case No. 1: A lot fronting on a street with sewer accommodations
will be computed by multiplying the lot frontage by $79 per linear
foot.
Case No. 2: A corner lot shall be assessed at the rate of $79
for each linear foot of lot frontage on the side of the lot that is
adjacent to the sewer.
Case No. 3: A corner lot where the sewer abuts both sides of
the lot shall be assessed by multiplying the longest side of the lot
by $79 per linear foot.
Case No. 4: A corner lot where the sewer abuts both sides of
the lot and has a frontage on the long side in excess of 150 feet,
yet has an area of less than 20,000 square feet, shall be assessed
for 150 feet of frontage at $79 per linear foot.
Case No. 5: A lot fronting on two streets (not a corner lot)
both of which are sewered and cannot be further subdivided based on
current zoning of the lot shall be assessed for the longest side at
the rate of $79 per linear foot.
Case No. 5a: A lot fronting on two streets (not a corner lot)
both of which are sewered and can be further subdivided based on current
zoning of the lot shall be assessed at the rate of $79 per linear
foot of lot frontage on each street.
Case No. 6: Lots that do not front on a Town accepted road and
that will receive sewer connections through a driveway, right-of-way,
easement, paper road, etc., shall be assessed at the rate of $79 per
linear foot for a minimum lot frontage of 50 feet plus the width of
the driveway, right-of-way, easement, paper road, etc.
Case No. 7: If the frontage of a lot is less than 50 feet, then
it shall be considered to have a minimum of 50 feet of frontage for
sewer assessment purposes and shall be assessed at the rate of $79
per linear foot.
If a situation arises that does not conform to the cases enumerated
hereinabove, the director of public works or his designee is hereby
authorized to compute the sewer assessment in accordance with the
method set forth in the ordinance, which in his sole discretion best
describes said situations.
Any prior sewer assessment payments made to the Town of Cumberland
for the projects listed herein will be credited to the new assessment
made pursuant to this ordinance.
The Finance Director shall permit deferred payment of annual
installments of sewer assessments made pursuant to article I of this
ordinance with respect to lots not connected to the Town's sewer system
which are owned and used as principal residence by a person or persons
(i) at least one of whom has attained the age of 65 or is disabled
and (ii) who had gross household income of $15,000 or less for the
preceding calendar year. Any person desiring to defer payment of an
annual installment shall apply to the finance director in writing
within 30 days after mailing of the installment bill for permission
to do so. No deferral shall be allowed unless the applicant files
a timely application setting forth the factual basis for the deferral
request. Any deferred payments shall be due not later than the earlier
of (i) any connection from the property to the Town's sewer system
or (ii) any transfer of the property. Interest will not be charged
on payments deferred pursuant to this section.
Sewer assessment rate bills shall be due and payable on the
date stated therein and all sewer assessment rate bills remaining
unpaid 31 days thereafter shall carry, until collected, a penalty
at the same percentage rate established by the Town for unpaid property
taxes, upon the unpaid amount and the current penalty charge for each
billing period.
The properties as listed in Exhibit "1997 Bond Sewer Assessment,
Monastery and Chapel Four Corners Area", attached to Ord. No. 01-34,
are subject to a sewer assessment charge of $68 per linear foot. Such
charge is payable in equal annual payments over the remaining life
of the bond, 18 years.

The following fees shall apply to all zoning applications and
appeals be heard by the Zoning Board of Review and/or Providence County
Superior Court.
Application for variance or special use permit: $350.
Appeal of Building Official: $350.
Other appeals to Zoning Board: $350.
Certificate of zoning compliance: $50.
The party filing the application or appeal shall be responsible
for the payment of all notices required by the provisions of G.L.
§ 45-24-1 et seq., and/or any notice by publication required
by said chapter of the general laws as well as the fee for recording
the decision in the Town's land evidence records.
The party filing an appeal of any Zoning Board of Review decision
to the superior court shall be responsible for the ordering of and
payment for the stenographic report of the entire proceeding appealed
from which shall be forwarded to the Zoning Board of Review for inclusion
with the certified record/documents required pursuant to G.L § 45-24-69
and responsible for the payment of all notices and advertisements
required by law.
The following fees shall apply to all applications for zone
changes and road abandonments.
Application for zone change: $700.
Application for road abandonment: $700.
The party filing the application for a zone change or road abandonment
shall be responsible for the payment of all notices required and notice
by publication required by the General Laws of the State of Rhode
Island. Additionally, the party requesting either a zone change or
road abandonment shall be responsible for payment of the recording
of the decision granting the zone change together with any limitations
and conditions imposed, in the land evidence records pursuant to G.L.
§ 45-24-53.
Single-family residence: $3,139.76.
Attached family accessory dwelling unit: $1,560.48.

The Town Council of the Town of Cumberland agrees to the establishment
of fees to be collected by the Parks and Recreation Department according
to the following:
(a)
Fields and courts.
(1)
There shall be a nine-tier pricing schedule for the Town's park
and athletic field network as described below:
a.
Group 1: Town Department programs and other official Town sponsored
and/or funded programs or events. School sanctioned games or events
take precedent on all Town fields.
b.
Group 2: Nonprofit youth recreational organizations (excluding competitive
programs) with at least 90% Cumberland residents.
Must be registered and operating only as a nonprofit throughout
the State of RI Tax number and registered name must be provided.
Organization must be open for participation to entire Town of

Organization must have an "everyone plays" philosophy, i.e.,
there are no skill testing requirements for participation.

Group 3: Nonprofit adult recreational organizations with at least
90% Cumberland residents.
Must be registered and operating only as a nonprofit through
the State of Rhode Island. Tax number and registered name must be
provided.
Organization must be open for participation to entire Town of
Cumberland.
d.
Group 4: Other nonprofit community organizations with at least 90%
Cumberland residents.
e.
Group 5: Other nonprofit youth organizations with less than 90% Cumberland
residents.
f.
Group 6: Other nonprofit adult with less than 90% Cumberland residents.
g.
Group 7: Other nonprofit community organizations with less than 90%
Cumberland residents.
h.
Group 8: For-profit commercial agency located within the Town limits
of Cumberland, with Parks and Recreation Director approval. (Includes
tournaments, camps and clinics.)
i.
Group 9: For-profit commercial agency located outside the Town limits
of Cumberland, with Parks and Recreation Director approval. (Includes
tournaments, camps and clinics.)

Field assignment priority. Field priority will be assigned by group
starting with Group 1 and ending with Group 9. If two groups are looking
to schedule a field then the priority tier will be given preference.
Additionally, sports that are "in season" as defined by the Cumberland
High School sports' schedule will be given preference on usage
during their in-season.

Pricing schedule. The following rates shall apply to field and court
rentals by group defined above:

Primary seasons of play with primary sport determined by Cumberland
High School sports schedule.

Within the first week of field usage a listing of total participants
and the Towns they reside in will be given to the Parks and Recreation
Director. If this results in a change in group level then the new
rates will be remitted immediately.

All usage charges will be remitted to the Town of Cumberland
prior to usage. For per hour/per field charges, an estimate of usage
will be determined prior to usage. At the end of usage a reconciliation
will be done to determine additional fees or any refund.

b.
Staff fees. When required.
1.
Town agent fees. When determined by the Parks and Recreation Director,
a Town agent(s) may be required to staff the event. All costs associated
with the employee's overtime will be borne by the renter.
2.
Police detail fees. When determined by the Police Chief, a police
detail officer(s) may be required to staff the event. All costs associated
with the employee's overtime will be borne by the renter.
3.
Fire detail fees. When determined by the Fire Chief, fire personnel
may be required to staff the event. All costs associated with the
employee's overtime will be borne by the renter.
4.
Rescue detail fees. When determined by the Director of Cumberland
Rescue Services, rescue personnel may be required to staff the event.
All costs associated with the employee's overtime will be borne
by the renter.
(b)
Park use fees.
(1)
Special event use: $500 per day plus additional charges for police,
fire and rescue as required by the license agreement.
(2)
Small group permit: $125 per day for birthday parties, special gatherings
when group size exceeds 25 persons.
(3)
Parks, fields, and courts use is by permit only. Violators are subject
to a fine of up to $150.
