A. 
The following activities or uses are absolutely prohibited at any Borough-owned park property:
(1) 
The possession, use or consumption of malt or alcoholic beverages or of any illegal drugs of any kind.
(2) 
Littering.
(3) 
Posting of signs, soliciting or peddling.
(4) 
Defacing or damaging property.
(5) 
Immoral, indecent or disorderly conduct.
(6) 
Snowmobiles or any other motorized vehicle, except automobiles or trucks weighing less than 8,000 pounds each.
(7) 
Use of tobacco products by any person regardless of age.
(8) 
The riding of skateboards, roller blades, or any other wheeled or rolling device on any walking trail, playground or shuffleboard court.
(9) 
Bicycling or bicycles except on parking areas or roadways.
(10) 
Camping, with or without a tent.
(11) 
Entering the park during the hours when the park is closed as provided under § 132-3.
(12) 
The use of any playground equipment or any other recreational equipment or facility in a manner or for a purpose other than its intended use.
(13) 
The use or occupancy of designated children's playground equipment by persons older than 12 years of age, except those persons directly supervising or assisting a child or children 12 years of age or less.
B. 
Special prohibitions for Fifth and Franklin Street Mini Park:
(1) 
Skateboards, roller blades, or any other wheeled or rolling device within the park.
Any person who shall violate any provision of this article shall, upon conviction thereof, be subject to a fine of not less than $25 and not more than $600, together with the costs of prosecution, and, in default of such fine and costs, shall be imprisoned for not more than 30 days.
The parks shall be open for public use between sunrise and sunset daily. It shall be a violation of this article to enter or remain in any of the parks at any other times except for an event or activity authorized by the Borough.
Operation of motor vehicles is prohibited in the parks, except on roadways and parking areas designed and improved for the purpose of vehicular travel and parking, or in other areas temporarily designated for said purpose on a temporary basis in connection with an authorized activity or event. Vehicles shall not be operated or parked so as to block passage of any roadway or access to any facility within the park.

Dogs shall be kept on a fixed-length, nonretractable leash with a total length not to exceed six feet and under the control of the owner, keeper, or other person responsible for the dog at all times.

The rules and regulations set forth hereinafter shall apply to all dams and/or watershed areas owned by the Borough of Boyertown, wherever situated.
The dams and watershed areas shall be open and posted, showing open hours in accordance with the following schedule:
A. 
Hours for fishing shall be from dawn until sunset, starting the second Saturday in April until November 1.
B. 
Hours for hunting shall conform to those of the Pennsylvania Game Commission, during the Pennsylvania Commonwealth game seasons.
Motorized vehicles are permitted on designated roadways and within designated parking areas only, but said parking areas should be occupied by dam and watershed areas users only, only during the hours hereinabove set forth in § 132-6.
Tents are not permitted in any watershed area except in the case of a camping expedition by either the Boy Scouts, the Girl Scouts, the Civil Air Patrol or the 4-H organizations located in the Boyertown Area School District. Such groups must have adequate adult supervision, an adult being the age of 21 years or older, and must obtain a permit from the Boyertown Borough Manager prior to such activity. A permit, when issued, will be good for not more than a period of 24 hours.
No fire shall be permitted at any time at any dam or watershed area, except in designated areas, except by either the Boy Scouts, Girl Scouts, the Civil Air Patrol or the 4-H organizations located in the Boyertown Area School District. Such groups must have adequate adult supervision and must obtain a fire permit from the Boyertown Borough Manager and the Fire Marshal. The permit, when issued, shall be good for not more than 24 hours.
The following activities are absolutely prohibited at any area:
A. 
Camping with or without a tent, except in the watershed areas when used by either the Boy Scouts, the Girl Scouts, the Civil Air Patrol or the 4-H organizations located in the Boyertown Area School District, in accordance with the provisions of §§ 132-8, 132-9 and 132-10.
B. 
Swimming or bathing at dams.
C. 
The possession, use or consumption of malt or alcoholic beverages or of illegal drugs of any kind.
D. 
Littering.
E. 
The possession, use or discharging of firearms, except for hunting on watershed properties where permitted by Borough permit, as issued by the Borough Manager.
F. 
Posting of signs, soliciting or peddling.
G. 
Defacing or damaging property.
H. 
Immoral, indecent or disorderly conduct.
I. 
Snowmobiles or any other motorized vehicle excepting automobiles or trucks weighing less than 8,000 pounds each.
J. 
Fishing in the dams from November 1 to the second Saturday in April. At any other time, fishing in the dams may take place only with a current Borough permit, as issued by the Borough Manager.
K. 
Trapping of animals.
L. 
Boating of any kind in the watershed area.
M. 
Smoking of a tobacco product by anyone under 18 years of age.
N. 
Skating or any other activities on the water in the watershed area.
O. 
Ice fishing.

Any person who shall violate this article shall be subject to an arrest without warrant, and any person so arrested shall be taken forthwith before a District Justice having a competent jurisdiction and, upon conviction of violation of this article, shall be sentenced to pay a fine of not less than $25 but not exceeding $600, together with the costs of prosecution, and, in default of such fine and costs, shall be imprisoned for not more than 30 days.
